Section 5 : It shall be unlawful for any person, <br /> firm or corporation to permit or allow any such game or device, <br /> as herein defined, then in its possession or under its control <br /> to be played or operated by any minor. <br /> Section 6: No license shall be issued for the <br /> operation or maintenance of any such machines or devices in <br /> any place within three hundred (300) feet of any private or <br /> public grade.jschool. <br /> Section 7: After an application has been granted, <br /> the City Clerk, by and with the consent of the Commissioner of <br /> Public Safety, shall have the right to renew said licenses <br /> for any such machines or devices from month to month, upon <br /> the payment of the license fee herein provided for. <br /> Section 8: The City Clerk shall at the time of <br /> issuing said licenses issue to said applicant a tag for each <br /> machine or device so licensed, and the same shall be at all <br /> times displayed upon any machine or device that is being maintained <br /> or operated in the City of Everett, said tag shall be in such <br /> form and of such material as the Commissioner of Safety shall <br /> determine. It shall be unlawful to operate, keep or display any <br /> such machine or device unless one of said tags is conspicuously <br /> displayed thereon. <br /> Section 9: The City Council of the City of Everett <br /> shall have the right to revoke any and all licenses issued here- <br /> under, either without or with notice to the licensee, and in <br /> the event of such revocation no part of the unearned portion of <br /> such license fee shall be refunded. <br /> Section 10: All licenses issued hereunder shall expire <br /> on the last day of each month; provided that the first licenses <br /> issued to any applicant if not i-sued on the first day of the <br /> month, the applicant shall be required to pay for such licenses <br /> only at the monthly rate of Five dollars (35.00) per month for <br /> each and every machine or device covered by said license. <br /> Section 11: Any person, firm or corporation violating <br /> any of the terms or provisions of this -ordinance shall, upon <br /> conviction thereof , be fined in the sum of not more than three <br /> hundred dollars ( 300.00) or by imprisonment in theCity Jail <br /> for a period of not more than ninety (90) days, or by both <br /> such fine and imprisonment. <br /> Section 12: An emergency is declared to exist and <br /> this ordinance shall take effect upon its passage and publication. <br /> MAYOR <br /> • <br /> Attest : <br /> 1ty Clerk <br /> Passed: June 16 , 1936 . <br /> Published: June 17 , 1936 . <br /> -2 <br />
