1 <br /> Broadway to Walnut Street by construction of Portland Cement Concrete <br /> Curbs according to the plans and specifications prepared under the direction <br /> of the City Engineer, which plans and specifications are hereby adopted and <br /> approved. <br /> Section 2. That a sum not to exceed 55' of the cost and expense of <br /> such improvement , including all necessary incidental expenses, plus Clerk <br /> and Treasurer's fees, shall be borne by and assessed against the property <br /> included in the assessment district herein created , in accordance with law; <br /> and the balance of the cost thereof, including all necessary incidental ex- <br /> penses , shall be paid from funds allocated to the City of Everett by Federal <br /> Grant made by the United States Government . The City of Everett shall not <br /> be liable for any portion of the costs and expenses of such improvement in <br /> excess of the amount above mentioned , except as provided in Chapter 141, <br /> Session laws of 1923, and Ordinance No. 2126 of the City of Everett. <br /> Section 3. There is hereby established a local improvement district, <br /> • to be called Local Improvement District No . which improvement dis- <br /> trict shall include the following described property, to-wit: <br /> All that property between. Rucker Avenue and Walnut Street that <br /> lies between the North margin of 19th Street , end a line two hun- <br /> dred (200) feet North and parallel thereto , also from the South <br /> Margin of 19th Street and a line two hundred (200) feet South and <br /> parallel thereto , with the exception of Streets and Alleys. <br /> Section 4. A special fund is hereby created , to be called Local Im- <br /> provement District Fund No. 517 , which shall constitute in the aggre- <br /> gate cf the several amounts assessed , levied and collected, on the several <br /> tracts and parcels of land in said Local Improvement District , and the pro- <br /> ceeds of the sale of the bonds of the said district, for the purpose of de- <br /> fraying the costs and expenses of such improvement as described herein, to- <br /> gether with the funds allocated to the City of Everett by Federal Grant from <br /> the United States Government. Cut of said fund shall be paid the bonds, the <br /> interest thereon and not to exceed fifty-five _(55%) per cent of the entire <br /> cost of such improvement. <br /> Section 5. The costs and expenses of not to exceed fifty-five (55,0 <br /> per cent of such improvement plus Clerk and Treasurer' s fees shall be defray- <br /> ed by special assessments payable in ten (10) equal annual installments, <br /> -2- <br />
