"Affiliated taxicab" means a taxicab associated with a group of taxicabs having <br /> multiple owners and operating under the same color, business name or other <br /> identification scheme, all of which must operate under an identical schedule of <br /> rates and charges. <br /> B. "Applicant"means any individual, affiliation representative or business entity <br /> applying for a license or renewal of a license under this ordinance. In the case of a <br /> business entity, "applicant"includes all officers, directors, shareholders, general <br /> partners, limited partners and managing partners of the entity, all persons vested <br /> with authority to manage or direct the affairs of the legal entity or to bind the legal <br /> entity in dealings with third parties, and all persons who have any ownership <br /> interest in the entity.. <br /> C. "City" means the City of Everett. <br /> D. "Contract agreement" means a written agreement signed by both parties in advance <br /> of the dispatch of a taxicab, for the service identified in the contract. <br /> E. "Cruising" means the driving of a for-hire vehicle, on the streets, alleys or public <br /> places of the city in search of, or soliciting, prospective passengers for hire. <br /> F. "Driver," "for-hire driver" and "operator" mean any person,whether agent, <br /> employee, contractor, subcontractor or lessee authorized to operate or physically <br /> engage in driving a for-hire vehicle carrying passengers or baggage for hire, <br /> whether or not such person is the owner of or has any financial interest in the <br /> ownership of such vehicle; provided, however,that the provisions of this ordinance <br /> shall not apply to drivers of motor vehicles operated by any municipal or privately <br /> owned, licensed nonprofit transit system. <br /> G. "For-hire vehicle" means a taxicab, sightseeing vehicle or special service vehicle. <br /> H. "Holder" means a person to whom a license has been issued. <br /> 2 <br />
