hire vehicle business. In making this determination, the clerk may consider the <br /> following: <br /> 1. Whether the applicant or any owner has been convicted of any law or ordinance <br /> reasonably related to the applicant's fitness or ability to operate a for-hire vehicle <br /> business, such as laws or ordinances pertaining to alcohol, controlled substances, <br /> prostitution, gambling, physical violence, fraud, larceny, extortion,theft and <br /> racketeering or any crime of moral turpitude; <br /> 2 Any other record and/or reputation as to the applicant being law-abiding; <br /> 3. The applicant's business experience and the nature and kind of occupation or <br /> business in which the applicant has previously been engaged; <br /> 3. The manner in which an applicant has previously conducted his or its business; <br /> 4. Any other conduct exhibited by the applicant which would lead the city clerk to <br /> reasonably conclude that the applicant or any owner is dishonest or immoral, or <br /> desires such license to enable him to engage in a dishonest,unlawful, or immoral <br /> act, practice or enterprise. <br /> Section 12: For-hire vehicle business license- Suspension and revocation. <br /> A. A for-hire vehicle business license will be suspended if the licensee does any of the <br /> following: <br /> 1. Fails to maintain in full force and effect the insurance required in this ordinance; <br /> 2. Fails to comply with the safety and sanitation requirements of this ordinance; <br /> 3. Authorizes any person to drive a for-hire vehicle which is not equipped and in safe <br /> condition as required by city ordinance and the requirements of this ordinance, as <br /> now or hereafter amended; <br /> 4. Allows a driver to operate a for-hire vehicle owned or operated by licensee when <br /> insufficiently covered by insurance; <br /> 5. Allows any person to drive a for-hire vehicle which is not equipped with seat belts <br /> for all passengers; <br /> 6. Falsifies any information on the application; or <br /> 7. A for-hire vehicle owned or operated by licensee's business was operated without a <br /> valid for-hire driver's license. <br /> B. A for-hire vehicle business license will be suspended or revoked if the licensee or <br /> any of its owners has been found to have done any of the following: <br /> 1. Operated or permitted the operation of the for-hire vehicle while the driver is using <br /> or in possession of alcohol or controlled substances, during its operation; <br /> 2. Falsified any record, document or information required to be kept or submitted to <br /> the City by this ordinance, or by rule or regulation prescribed thereunder; <br /> 3. Violated any of the provisions of this ordinance; <br /> 4. Violated any of the ordinances of the City or the laws of the state,the violation of <br /> which reflects unfavorably on the fitness of the license holder to offer public <br /> transportation; or <br /> 5. Engaged in unfair methods of competition and/or unfair or deceptive acts or <br /> practices. <br /> Section 13: Suspension, revocation and denial-Hearings and appeals. <br /> 7 <br />
