In no case shall the <br /> amounts sought or paid for each piece of equipment exceed the rates established by the <br /> Equipment Rental Agreement even if the actual cost for such equipment is higher. The <br /> Owner may audit the Contractor's cost records to determine actual equipment cost. The <br /> following information shall be provided for each piece of equipment: 111 <br /> i. Detailed description(e.g., Motor Grader Diesel Powered Caterpillar 12 "G", Tractor <br /> Crawler ROPS&Dozer Included Diesel) <br /> ii. The hours of use or standby;and <br /> iii. The specific day and dates of use or standby; <br /> iv. Job Overhead. <br /> v. Overhead(general and administrative). <br /> vi. Subcontractor's contract claims (in the same level of detail as specified herein is <br /> required for all Subcontractor's contract claims); and , <br /> vii. Other categories as specified by the Contractor or the Owner. <br /> 10. A notarized statement shall be submitted to the Owner's Representative containing the following <br /> language: <br /> Under the penalty of law for perjury or falsification,the undersigned, <br /> 1 <br /> (name) (title) <br /> of 1 <br /> (company) <br /> hereby certifies that the Contract Claim for an adjustment of the Contract Sum and/or <br /> Contract Time,if any,made herein for Work on this Contract is a true and complete <br /> statement of the factual basis of the Contract Claim and all actual costs incurred and time <br /> sought,and is fully documented and supported under the Contract between the parties. <br /> Date /s/ <br /> Subscribed and sworn before me this day of <br /> Notary Public <br /> My Commission Expires: ' <br /> 12.3 FALSE OR OMITTED INFORMATION <br /> The Contractor waives each Contract Claim for which it presents material information that it knows,or in <br /> the exercise of reasonable care should know,is false, or omits or fails to disclose material information <br /> relating to such Contract Claim. In such case,Contractor shall reimburse the Owner for any and all fees <br /> and expenses incurred in investigating any such Contract Claim. <br /> 12.4 REMEDIES <br /> 12.4.1 General , <br /> If a Contract Claim has merit in whole or in part,then Contractor's sole remedies shall be those provided <br /> in this subsection.
