IEREAS, because of necessity and unforeseen circumstances arising which re- <br /> quired the performance of needed improvement upbn the water system between the 1st <br /> day of January", 1935, and the enatbtment of 'this ordinance and which work could be <br /> and has been performed by delinquent water customers, and as to all such acts the <br /> provisions of this ordinance should be and may be made retroactive . <br /> THE CITY OF EVE'RETP DOES ORDAIN: <br /> Section 1. That a public emergency exists which could not reasonably have <br /> been foreseen at the time of the making of the budget for the year 1935, to-wit; <br /> in October, 1934; that said emergency has been caused in the Department of Public <br /> Works, more particularly the Water System thereof, by reason of the' fact that ec- <br /> onomic conditions are such that the regular water department crew is depleted in <br /> numbers and exceedingly large numbers of water customers are unable to pay their <br /> water bills, which was rot foreseen or anticipated would continue for so long a <br /> period ; that the City Council believes that a plan should be effected , furnishing <br /> employment to delinquent water customers, to be applied only to such customers <br /> n arrears for not less than f our (4) months and not f nr current bills, and that <br /> all warrants drawn in payment of indebtedness for such labor or services as here- <br /> in described he immediately assigned by the payee to defray the payment of any <br /> water bill which he owes to the water department of the City of 'Everett . <br /> Section 2. That a rind designated as "The Water Arrearage Relief Fund" be <br /> established by the „raper officials of the city of Everett into which shall be <br /> raid the sum of Fifteen Thousand ( ].5,000) Dollars, or such other sum as may be <br /> necessary for this use, to be taken out of any funds belonging to the ',later De- <br /> partment not otherwise appropriated , for a revolving fund ; that any warrants <br /> drawn upon this fund are to be emergency warrants, limited to the payment for <br /> services rendered by the delinquent water customer upon the water system of the <br /> City, as disclosed by "The Water Arrearage Fay Roll", the employees to be desig- <br /> nated as "The Water Arrearage Crew" known as "Work Order No. _» <br /> Section 3. That no employee carried on the "Water Arrearage Crew Fay Roll" <br /> shall be paid or receive any cash for his services, nor shall any other compensa- <br /> tion be paid or promised him other than that which is to be applied upon such em- <br /> ployee's indebtedness for water sold and delivered for his use by the Water Depart- <br /> ment; and before any employment is furnished or begun, said water customer shall <br /> sign a memorandum of agreement which shall incorporate therein the covenants <br /> -2- <br />
