ORDINANCE NO. 2629. An Ordinance providing for the improvement of Lombard Avenue , from the manhole North of 12th Street to 9th Street , by the construction of a sewer and its necessary aprurtenances and doing all other work on the entire dis- trict necessary to make a complete improvement; creating an assessment dis- trict; creating a local improvement district fund therefor; providing that payment for said improvement be made by special assessment on the property in the said district under the mode of payment by bonds , for material used, fixed estimate and incidental expenses at an approximation cf 25% of the to- tcl costs and the remaining costs to be paid by Federal funds donated as labor under the WERA plan of the Federal government . WHEREAS , a majority petition of the property owners, petitioning for said improvement , has heretofore been filed with the City Council, and upon examina- tion thereof the said City Council has found the said things as set forth there- in to be true ; and WHEREAS , the said petition has been referred to the Commissioner of Public 7orks to be examined by the said Commissioner and the engineer and the Commis- sioner of Public Works has filed with the City Council all data and information, as required by law; and WHEREAS , said Commissioner of Public Work:_ has recommended to the City Council that said improvement petitioned for be made , and it appearing to the City Council that the public health, convenience and necessity require such improvement to be made ; and 71A EAS , it further appears that such improvement should only be made in the event that Federal funds may be secured from the WERA in the payment of the labor costs , estimated at 75% of the total cost thereof, and the property owners of the district be assessed a sum for the cost of materials and fixed estimate, estimated at approximately 25% of the total cost cf said improvement , and the City Council being of the opinion that such improvements should only be com- menced upon the assurance that the ratio of costs therefor will be incurred in that proportion and no more ; Now, Therefore , THE CITY OF EVERETT DOES ORDAIN: Section 1 . That Lombard Avenue , from the manhole North of 12th Street to 9th Street, be improved by the construction of a sewer and its necessary appur- tenances, and doing all other work_ on the entire district to make a complete im- provement according to the plan and specifications prepared under the direction of the City Engineer , which plans and specifications are hereby adopted and ap- proved. -1-
