EVERGSS0220T, and has posted with the state a bond or deposit <br />of $4,000/$6,000 for the purpose of satisfying claims against the contractor for breach of contract including negligent or improper work in <br />the conduct of the contractor's business. The expiration of this contractor's registration is every September, and is renewed each year. <br />THIS BOND OR DEPOSIT MIGHT NOT BE SUFFICIENT TO COVER A CLAIM THAT MIGHT ARISE FROM THE WORK <br />DONE UNDER YOUR CONTRACT. <br />This bond or deposit is not for your exclusive use because it covers all work performed by this contractor. The bond or deposit is intended to <br />Dav valid claims that you or other customers. suppliers, subcontractors or taxine authorities may have. <br />FOR GREATER PROTECTION YOU MAY WITHHOLD A PERCENTAGE OF YOUR CONTRACT. <br />You may withhold a contractually defined percentage of your construction contract as retainage for a slated period of time to help insure that <br />your project will be completed as required by your contract. <br />YOUR PROPERTY MAY BE LIENED. <br />If a supplier of materials used in your construction project or any employee/subcontractor of your contractor or subcontractors is not paid, <br />your property may be liened to force payment and you could pay twice for the work. <br />FOR ADDITIONAL PROTECTION, YOU MAY REQUEST THE CONTRACTOR TO PROVIDE YOU WITH ORIGINAL <br />"LIEN RELEASE" DOCUMENTS FROM EACH SUPPLIER OR SUBCONTRACTOR ON YOUR PROJECT. <br />The contractor is required to provide you with further information about lien release documents if you request it. General information is also <br />available from the state Department of Labor & Industries. <br />TERMS & CONDITIONS OF THIS AGREEMENT <br />1 Authorized Purchaser or Authorized Representative of the company stated hereby accepts the equipment and service described <br />above and agrees to pay Evergreen the price shown above. <br />2 Evergreen shall not be liable for any damage caused by events beyond its control, including but not limited to, fire, flood, strikes, <br />accidents, or delays affecting this work or other operations in which it is involved, directly or indirectly. <br />3 Equipment or system failure due to lack of proper maintenance, service, or abuse is expressly excluded from any labor warranty. <br />Scheduling regular annual maintenance check-ups and filter replacements are the responsibility of Authorized Purchaser and/or <br />Authorized Representative. <br />4 There are no warranties, expressed or implied, for existing equipment, ductwork, or other materials not installed by Evergreen. <br />5 Purchaser shall permit Evergreen reasonable access to the property on which equipment is to be installed. Title to all provided <br />equipment remains with Evergreen until all amounts due thereon are paid in full, whether such equipment is affixed to the realty or <br />not, and shall remain personal property and be deemed sever -able without injury to the freehold. <br />6 Payment to be made as follows: balance in completion upon issuance of invoice. Invoice will be emailed to Authorized <br />Representative as stated in this contract along with date of completed work. Payment is due upon receipt of this email <br />communication. <br />
