ORDINANCE NO. 2593 <br /> An Ordinance amending Ordinance No. 2583 , known as the Beer and Ane" <br /> Ordinance", entitled as follows: <br /> "An Ordinance providing for the licensing for revenue and for regu- <br /> lation of the sale of Federal legalized beer and wine within the <br /> City of Everett, providing rules and regulations therefor, and pen- <br /> alties for the violation thereof, repealing Ordinance No. 2580 and <br /> all other ordinances and parts of ordinances in conflict herewith <br /> and declaring an emergency." <br /> by amending Section 1 thereof and adding thereto a new section, designated <br /> as Section 2a: <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Section 1 of Ordinance No. 2583 be amended so as to <br /> read as follows , to-wit: <br /> DEFINITIONS <br /> Section 1: As used in this Ordinance , (a) the words "beer" and "wine" <br /> shall be taken and construed to mean and include beer or wine containing <br /> not more than 14 per cent of alcohol by weight or 17.5 per cent by volume . <br /> (b) A "wholesaler" means an individual, firm or corporation who whole- <br /> sales beer, only , containing not more than 14 per cent of alcohol by weight <br /> or 17.5 per cent by volume, in barrel, keg, or case, or in larger quantities . <br /> (c) A "beer and/or wine parlor operator" means an individual or indi- <br /> viduals catering specially to the sale of beer and/or wine by retailing <br /> drinks to the public; sail wine to be consumed upon the premises, only. <br /> (d) "Restaurant Retailer" shall be divided into two classes (a) and <br /> (b) . Class (a) means an individual, firm or corporation selling and serv- <br /> ing to its patrons in a regularly operated restaurant , bottled beer and <br /> wine containing not more than 14 per cent of alcohol by weight or 17.5 per <br /> cent by volume , to be consumed on the premises , only. Class (b) means an <br /> individual, firm or corporation selling and serving both draught and bottled <br /> beer or wine to its patrons in a regularly operated restaurant, said wine <br /> to be consumed upon the premises, only. <br /> (e) "Grocers" may be licensed to sell bottled beer, only, containing <br /> not more than 14 per cent of alcohol by weight or 17.5 per cent by volume, not <br /> to be consumed on the premises, in quantities not to exceed one (1) case . <br /> -1- <br />
