• EMC 8.20.020 Nuisances-Residential property and nonresidential property
<br /> Except as authorized by subsection H of this section or as may be allowed by another city
<br /> ordinance,no person owning, leasing,renting,occupying or having charge or possession of any
<br /> property in the city,including vacant lots,shall maintain or allow to be maintained on the
<br /> property outside of a fully enclosed structure such as a shed,dwelling, or closeable garage,any
<br /> of the following conditions visible from any street,alley,or other public or private property:
<br /> A. Junk,trash, litter, boxes,discarded lumber, salvage materials or other similar materials;
<br /> ***
<br /> C. Broken or discarded furniture, household equipment and furnishings;
<br /> ***
<br /> G. Vehicle parts or other articles of personal property which are discarded or left in a state of
<br /> partial construction or repair;
<br /> ***
<br /> IPMC 308,1 Accumulation of Rubbish and Garbage
<br /> All exterior property and premises, and the interior of every structure,shall be free from
<br /> accumulation of rubbish or garbage.
<br /> The use of nonhabitable spaces for sleeping purposes is a violation of International Property
<br /> Maintenance Code(IPMC)sections 404,4.4&404.4.5,which read:
<br /> • !MC 404.4.4 Prohibited Occupancy,Kitchens and nonhabitable spaces shall not be used for
<br /> sleeping purposes.
<br /> IMPC 404.4,5 Other Requirements,Bedrooms shall comply with the applicable provisions of this
<br /> code including, but not limited to,the light,ventilation,room area,ceiling height and room
<br /> width requirements of this chapter;the plumbing facilities and water heating facilities of
<br /> Chapter 5;the heating facilities and electrical receptacle requirements of Chapter 6;and the
<br /> smoke detector and emergency escape requirements of Chapter 7.
<br /> The unpermitted replacement of the rear entry stairs without required permits and approvals is a •
<br /> violation of the International Residential Code (IRC)105.1,Permits required,and renders the
<br /> structure(s)Unlawful as defined by the International Property Maintenance Code(IPMC)in violation of
<br /> IPMC 106.1,which read:
<br /> • IRC 105.1 Required.
<br /> Any owner or authorized agent who intends to construct,enlarge,alter, repair,move,demolish •
<br /> or change the occupancy of a building or structure,or to erect,install,enlarge,alter, repair,
<br /> remove,convert or replace any electrical,gas, mechanical or plumbing system,the installation
<br /> of which is regulated by this code,or to cause any such work to be done,shall first make
<br /> application to the building official and obtain the required permit.
