IPMC 108.1.4 Unlawful structure. An unlawful structure is one found in whole or in part to be occupied by more persons than permitted under this code,or was erected,altered or occupied contrary to law. IPMC 106.1 Unlawful acts. It shall be unlawful for a person,firm or corporation to be in conflict with or in violation of any of the provisions of this code. CORRECTIVE ACTIONS REQUIRED: The Responsible Person(s)shall take the following actions to correct the Code Violations at the Property: 1. Remove and properly dispose of unwanted items discarded on the property. 2. Items you wish to keep must be stored in an enclosed area. 3. Ensure all garbage and trash is removed and that the exterior property and premises is maintained in a clean and sanitary condition,free from accumulation of litter or garbage 4. Cease use of the basement for sleeping or other residential purposes. Complete items 1—4 not later than August 9,2023 5. Submit complete applications for all of the necessary and required permits and approvals to bring the structure(s)on the property into compliance with the Everett Municipal Code. Information on the City of Everett permit application process can be found at www.everettwa.gov/permits Once the Building Permits are issued,then correct and complete all of the deficiencies that are present within the structure(s)and have the work inspected and approved,by the Everett City building Division. Complete items 5 not later than October 23,2023 Note that all required permits(if applicable)to perform the corrective action must be obtained from the proper issuing agency. CIVIL PENALTIES: If the corrective action is not completed by the date set for compliance, a monetary penalty in the amount of$250 shall accrue for each day or portion thereof that each violation continues beyond the date for compliance set in this Notice and Order, until compliance with the Notice and Order is achieved. (EMC 1.20.190) IMPORTANT NOTE:PAYMENT OF THE MONETARY PENALTY DOES NOT RELIEVE THE VIOLATOR OF THE DUTY TO CORRECT, ABATE OR STOP THE CODE VIOLATIONS AND/OR PAY ANY AND ALL OTHER COST ASSESSED. COST OF ENFORCEMENT: Per EMC 1.20.180, the City is authorized to recovery any and all costs of enforcement related to ensuring the Property is brought into compliance.
