Such work does not have a grandfathered status. A permit is required to make the spaces legal. The spaces need to conform to the requirements of the IRC. The code does provide some reduction of clearances for converting existing basements, including in the appendices. Attached are a couple of documents to assist you in preparing construction drawings. Note that these are not intended to cover all of the code requirements that may apply to your project, and some of the listed requirements may not apply to your project. We recommend that you consider obtaining the services of a licensed design professional if you are not familiar with the building codes or preparing construction drawings. The house should be reviewed carefully for additional unpermitted work. Unpermitted work should be included in the scope -of -work of the proposed permit, and should be identified as new even if it is currently in -place; see the attached documents for additional commentary. The City of Everett and the Snohomish County records should be reviewed. Be aware that county records only provide an indication of whether the current construction matches older records, and do not constitute a permitted condition. The old assessors field notes should be obtained from the county; on-line information is relatively recent and as noted does not constitute a permitted condition.
