lacks sufficient ceiling height to be habitable spaces. The ceiling height on these levels
<br />is 80 inches, short of the 84 inches required, yet these spaced have been finished and
<br />contain sleeping rooms. The doorway for the internal connection between the main
<br />floor and basement has been locked and screwed shut. The basement is accessed by a
<br />separate entrance, contains the single electrical panel for the structure, and contains a
<br />second kitchen, living room, laundry and two bedrooms. The gas furnace is located in
<br />the basement — near the center of the floor and is adjacent to the kitchen and other
<br />occupied space. The inspection further found several electrical outlet/receptacle boxes
<br />on the main floor level were uncovered, exposing electrical wiring, or improperly
<br />secured to the wall, causing them to hang from the wall.
<br />A. The unpermitted alterations to the structure, and the creation of a new dwelling unit
<br />without approvals, are violations of International Residential Code (IRC)
<br />R105.1, which reads:
<br />IRC R105.1 Required.
<br />Any owner or authorized agent who intends to construct, enlarge, alter, repair,
<br />move, demolish or change the occupancy of a building or structure, or to erect,
<br />install, enlarge, alter, repair, remove, convert or replace any electrical, gas,
<br />mechanical or plumbing system, the installation of which is regulated by this code,
<br />or to cause any such work to be done, shall first make application to the building
<br />official and obtain the required permit.
<br />EMC 19,41,050 Building permits and sign permits —Compliance with this
<br />title required,
<br />A. Unless otherwise exempted by city building regulations, no person, firm or
<br />corporation shall erect, construct, enlarge, expand, alter, repair, move, remove,
<br />convert or demolish, equip, use, occupy, or maintain any building or structure
<br />(including signs) or cause or permit the same to be done without obtaining a
<br />building permit or sign permit.
<br />B. The unpermitted alteration to the structure and to the use/occupancy renders the
<br />structure Unlawful and Unfit for Human Occupancy as defined by the International
<br />Property Maintenance Code (IPMC) 108.1.4 and 108.1.3, in violation of
<br />IPMC 106.1, which read;
<br />IPMC 108.1,4 Unlawful structure.
<br />An unlawful structure is one found in whole or in part to be occupied by more
<br />persons than permitted under this code, or was erected, altered or occupied
<br />contrary to law.
