A structure is unfit for human occupancy whenever the Code Official finds that such <br />structure in unsafe, unlawful or, because of the degree to which the structure is in <br />disrepair or lacks maintenance, is unsanitary. vermin or rat infested, contains filth or <br />contamination, or lacks ventilation, illumination, sanitary or heating facilities or other <br />essential equipment required by this code, or because of the location of the <br />structure constitutes a hazard to occupants of the structure or to the public. <br />IPMC 106.1 Unlawful acts, <br />It shall be unlawful for a person, firm or corporation to be in conflict.with or in <br />violation of any of the prowsions'of this code. <br />C. The attic and basement levels lack the minimum ceiling height (7 feet) required by <br />IPMC 404.3 for habitable spaces. The use of non -habitable spaces for sleeping <br />purposes, such as the attic and basement levels are violations of International <br />Property Maintenance Code (IPMC) sections 404.3, 404.4.4 & 404.4.5, <br />which read: <br />IPMC 404.3 Minimum ceiling heights; Habitable spaces, hallways, corridors, <br />laundry areas, bathrooms, toilet rooms, and habitable basement areas shall have a <br />minimum clear ceiling height of 7 feet <br />IPMC 404.4.4 Prohibited Occupancy, Kitchens and nonhabitable spaces shall <br />not be use for sleeping purposes <br />IMPC 404.4.5 Other Requirements, Bedrooms shall comply with the applicable <br />provisions of this code including, but not limited to, the light, ventilation, room area, <br />ceiling height and room width requirements of this chapter; the plumbing facilities <br />and water heating facilities of Chapter 5; the heating facilities and electrical <br />receptacle requirements of Chapter 6; and the smoke detector and emergency <br />escape requirements of Chapter 7. <br />5. Corrective Action, Deadline <br />If the Respondent completes the following corrective action by the date listed below, <br />and is not a repeat violator, the respondent may enter into an agreed order as <br />described in Section 7 below. <br />a) The entire structure must be vacated no later than Monday June 3 <br />2019 at 6.00 p.m. <br />b) The structure shall remain vacant and secure until occupancy is approved by <br />the City of Everett. <br />Everett Police Department, Code Enforcement Unit •3002 Wetmore Ave - Everett, WA 98201 425-257-8560 <br />Page13 <br />
