<br /> Based upon a review of record, the following findings of fact and conclusions of law hereby
<br /> constitute the basis of the decision of the Everett Violations Hearing Examiner.
<br /> FINDINGS OF FACT
<br /> 1. Titan Real Estate Holding LP (Respondent)is the owner of property at 8411 E. Xavier Way,
<br /> Everett, Washington(subject property), which is in an R-3,Multiple Family Medium
<br /> Density zone, Tian Shan(Kevin) Dong is the registered agent for Titan Real Estate Holding
<br /> LP. (Exhibit #9, Washington Secretary of State Business Information, dated March 4, 2020)

<br /> 2. In response to a complaint of an illegal rooming house, City of Everett Code Enforcement
<br /> Officer Eileen Hinkley conducted an inspection of the residential structure located on the
<br /> subject property on July 23,2019. While on site, Officer Hinkley observed and
<br /> photographed that the main level of the residential structure included a living room,dining
<br /> room, kitchen,bathroom, occupied bedroom, and laundry area; three bedrooms (two
<br /> occupied) and a bathroom were located on the upper level of the structure; and a family
<br /> room and occupied bedroom were located in the basement level. Officer Hinkley noted that
<br /> the basement was fully finished and that two twin beds (pushed together),a television,
<br /> nightstand, and a bureau had been placed in the basement family area, indicating that the
<br /> • area was being used for sleeping purposes. (Exhibit#1 h-1 w, Inspection Photos, dated July

<br /> 3. On July 25, 2019, City of Everett Building Division Chief Inspector Ted de Budden
<br /> provided the following information to Officer Hinkley:
<br /> a. City records indicated that a construction permit was issued for the residential structure
<br /> on December 25, 1995 and the plans submitted with the application indicated that the
<br /> basement would not be finished.
<br /> b. Chief Inspector de Budden conducted an inspection of the framing on March 15, 1996
<br /> and noted that the basement was unfinished.
<br /> c. A review of City records revealed that no permits had been applied for or obtained for
<br /> finishing the basement.
<br /> Chief Inspector de Budden informed Officer Hinkley that construction,plumbing,
<br /> mechanical, and electrical permits would be required to bring the finished basement into
<br /> compliance with City ordinances and recommended that the basement of the residential
<br /> structure be vacated as soon as possible. (Exhibit#5, Email from Ted de Budden, dated July

<br /> 4. On August 14, 2019,Kevin Dong,registered agent for Titan Real Estate Holding LP,
<br /> informed Officer Hinkley that the finished basement and converted garage already existed
<br /> when he purchased the property on December 31, 2015. Mr. Dong further said that there
<br /> were currently four people living in the house and if they chose to sleep in rooms other than
<br /> bedrooms, he did not have control over them. (Exhibit#6, Email from Kevin Dong, dated
