5. On August 14, 2019, a notice to comply was sent via first class mail to the Respondent <br /> informing him of conditions that were in violation of City ordinances. The notice provided <br /> a corrective action date of August 31, 2019 to return the occupancy of the residential <br /> structure to that of a single-family and February 28, 2020 to apply for and obtain required <br /> City permits. (Exhibit#7, Notice to Comply, dated August 14, 2019 (Testimony of Code <br /> Enforcement Officer Hinkley) <br /> 6. On September 3,2019, Officer Hinkley reinspected the subject property and observed and • <br /> photographed that the attached garage had been converted into a bedroom with a closet, the <br /> drywall had not been finished and the walls had not been painted,the area was not occupied; <br /> and the twin beds and furniture remained in the family area in the basement. Upon research <br /> of City records, Officer Hinkley determined that the Respondent had not applied for or <br /> obtained the required City permits for the basement and garage alterations. On October 8,2019, Officer Hinkley and other City staff met with Mr. Dong to review City <br /> requirements of applying for all necessary permits to bring the subject property into <br /> compliance. On February 11, 2020, Officer Hinkley contacted Mr. Dong and was informed that he had <br /> contacted an architect to submit a plan for the alterations conducted within the basement and <br /> attached garage. Mr. Dong assumed that the architect had contacted the City to apply for the <br /> required permits. Officer Hinkley found that permits had not been applied for or obtained. <br /> (Testimony of Code Enforcement Officer Hinkle)) <br /> 9. On February 18,2020,the City issued a violation citation to the Respondent for violations <br /> of: International Residential Code(IRC) R105.1 Permit Required as adopted by EMC <br /> 16.005.010;International Property Maintenance Code(IPMC) 106.1 Unlawful Acts as <br /> adopted by EMC 16.005.010; IPMC 108.1.3 Structure Unfit for Human Occupancy as <br /> adopted by EMC 16.005.010;and IPMC 108.1.4 Unlawful Structure as adopted by EMC <br /> 16.005.010 and IPMC 404.4.4 Prohibited occupancy as adopted by EMC 16.005.010. <br /> Copies of the violation citation were sent via first class and certified mail to the <br /> Respondent's last known address,which Officer Hinkley obtained from Snohomish County <br /> Assessor's record. A copy of the violation citation was posted on the subject property. <br /> Each method of service used is independently sufficient to provide notice pursuant to EMC <br /> 1.20.010.C.1. On February 18,2020, a notice of condemnation was sent via first class and certified mail to <br /> the Respondent which required the entire structure with attached garage be vacated no later <br /> than March 18, 2020 and remain vacant until and if occupancy is approved by the City of <br /> Everett Building Division.
