IPMC 106.1 Unlawful acts. <br />It shall be unlawful for a person, firm or corporation to be in conflict with or in violation of any of the <br />Provisions of this code. <br />The current use of the residential structure is consistent with that of a rooming house. Rooming houses <br />are prohibited in R-1 zones, as indicated in Table 5.1 within EMC 19.5. The Everett Municipal Code <br />(EMC) permits a maximum of two roomers within a single family residence in single family zones, or up <br />to four unrelated adults if they operate as a family as defined by EMC 19.4.020. The existing conditions <br />violate EMC 19.5.010 and EMC 19.39.060, which read; <br />EMC 19.S.010 Permitted uses, prohibited uses. <br />Land uses which are listed in the use table of this chapter shall be permitted subject to the review process <br />listed in the table for a specific use in a particular use zone. If a use is not listed specifically or generally in <br />a specific zone in the use table, it shall be considered to be a prohibited use in that zone. See Section <br />2.080(D)(2) for information on planning director interpretations on uses which are not listed in the use <br />tables. <br />EMC 19.39.060 Boarding and rooming, <br />In single-family zones, rental of rooms for lodging is limited to two roomers. There shall be no separate <br />kitchen facilities in rented rooms. <br />The use of non -habitable spaces for sleeping purposes, such as the basement, and garage are violations <br />of International Property Maintenance Code (IPMC) section 404.4.4, which reads: <br />IPMC 404.4.4 Prohibited Occupancy <br />Kitchens and non -habitable spaces shall not be used for sleeping purposes. <br />To resolve these issues, you must: <br />I. Return the occupancy and use of the residence to that of a single family no later than, August <br />31, 2019. <br />2. The basement area, and first floor garage room must be vacated and may not be used for <br />residential or sleeping purposes unless approved by the City of Everett Building Department. <br />This corrective action must be completed no later than, A 31 August , 2019 at . 1:00 pm. <br />3. Contact the City of Everett Planning Department to obtain information regarding permitted and <br />prohibited uses and to ensure compliance with all City Code requirements. <br />4. Contact the City of Everett Building and Planning Divisions located at 3200 Cedar Street and <br />apply for and obtain all of the necessary and required permits to bring the entire structure(s) <br />into compliance with the Everett Municipal Code. You shall then correct and complete all of the <br />deficiencies that are present within the structure(s) and have the work inspected and final <br />approval, by the Everett City Building Division.
