An inspection of your premises/property <br />located at 8411 E XAVIER WAY, was made on July 23, 2019. The inspection <br />revealed portions of the single family residence have been altered to create <br />additional living/sleeping spaces without required permits and approvals <br />including: the garage and basement area. The garage and basement now <br />contain newly finished living and sleeping areas. The inspection revealed 5 <br />different rooms were occupied, two bedrooms on the upper level, the <br />converted garage and two portions of the basement. This indicates 5 or more <br />persons currently occupy the structure. City code allows up to 4 unrelated <br />persons, living together as a family, to occupy a single family residence. The <br />occupancy of more than 4 unrelated persons is consistent with that of a <br />rooming house. Rooming houses are prohibited in R-1 zones, as indicated in <br />Table 5.1 within EMC 19.5. Records indicate there were no permits issued or <br />finalized for finishing the basement, or converting the garage to living space. <br />This inspection confirmed the following violations of the International Property <br />Maintenance Code (IPMC) and Everett Municipal Code (EMC): <br />The construction, demolition and/or alteration of a structure, and unpermitted <br />alterations is a violation of International Residential Code R105.1, Permits <br />required, renders the structure unlawful as defined by the International <br />Property Maintenance Code (IPMC) 108.1.4 and is in violation of IPMC 106.1, <br />which reads: <br />IRC R105.1 Required. <br />Any owner or authorized agent who intends to construct, enlarge, alter, repair, <br />move, demolish or change the occupancy of a building or structure, or to erect, <br />install, enlarge, alter, repair, remove, convert or replace any electrical, gas, <br />mechanical or plumbing system, the installation of which is regulated by this <br />code, or to cause any such work to be done, shall first make application to the <br />building official and obtain the required permit. <br />IPMC 108.1.4 Unlawful structure. <br />An unlawful structure is one found in whole or in part to be occupied by more <br />persons than permitted under this code, or was erected, altered or occupied <br />contrary to law. <br />
