IPMC 106.1 Unlawful acts. <br /> It shall be unlawful for a person, firm or corporation to be in conflict with or in violation <br /> of any of the provisions of this code. <br /> The use of non-habitable spaces for sleeping purposes, such as the basement, and <br /> garage are violations of IPMC 108.1.3 and IPMC 404.4.4, which reads: <br /> IPMC 108.1,3 Structure unfit for human occupancy. <br /> A structure is unfit for human occupancy whenever the code official finds that such <br /> structure is unsafe, unlawful or, because of the degree to which the structure is in <br /> disrepair or lacks maintenance, is insanitary, vermin or rat infested, contains filth and <br /> contamination, or lacks ventilation, illumination, sanitary or heating facilities or other <br /> essential equipment required by this code, or because the location of the structure <br /> constitutes a hazard to the occupants of the structure or to the public. <br /> IPMC 404.4.4 Prohibited Occupancy <br /> Kitchens and non-habitable spaces shall not be used for sleeping purposes, <br /> 5. Corrective Action, Deadline <br /> If the Respondent completes the following corrective action by the date listed below, <br /> and is not a repeat violator, the respondent may enter into an agreed order as <br /> described in Section 7 below. <br /> a) The converted garage must remain vacant and the basement area including the <br /> bedroom, must be vacated immediately and neither may not be used for <br /> residential or sleeping purposes unless approved by the City of Everett Building <br /> Department. <br /> b) Contact the City of Everett Building and Planning Divisions located at 3200 Cedar <br /> Street and apply for and obtain all of the necessary and required permits to bring <br /> the entire structure(s) into compliance with the Everett Municipal Code. You <br /> shall then correct and complete all of the deficiencies that are present within the <br /> structure(s) and have the work inspected and final approval, by the Everett City <br /> Building Division. <br /> This corrective action must be completed by August 18, 2020. <br /> 6.
