PP <br /> 40 <br /> ORDINANCE No. 2583 <br /> An Ordinance providing for the licensing for revenue and <br /> for regulation of the sale of Federal legalized beer and wine within <br /> the City of Everett , providing rules and regulations therefor and <br /> penalties for the violation thereof, repealing Ordinance No. 2580 <br /> and all other ordinances and parts of ordinances in conflict here- <br /> with, and declaring an emergency. <br /> THE CITY OF EVERETT DOES ORDAIN: - <br /> DEFINITIONS. <br /> Section 1: As used in this Ordinance, <br /> (a) The words "beer and/or wine" shall be taken and construed <br /> to mean and include beer and/or wine containing not more than 3.2 per <br /> cent of alcohol by weight or 4 per cent by volume as legalized by the <br /> Federal government. <br /> (b) A "wholesaler" means an individtal, firm or corporation <br /> who wholesales beer and/or wine in barrel, keg or case , or in larger <br /> quantities. <br /> (c) A "beer and/or wine parlor operator" means an individual <br /> or individuals catering specially to the sale of beer and/or wine by <br /> retailing drinks to the public. <br /> (d) "Restaurant retailer" shall be divided intt two classes, <br /> (a) and (b) . Class (a) means an individual, firm or corporation sell- <br /> ing and serving only bottled beer and/or wine in a regularly operated <br /> restaurant. "Class (b) means an individual, firm or corporation sell- <br /> ing and serving both draught and bottled beer and/or wine in a regular- <br /> ly operated restaurant. <br /> (Bottled) <br /> (e) "Grocers" and "druggists" may be licensed to sell/beer and <br /> wine in quantities not to exceed one case which beverages are not to <br /> be consumed upon the premises of the seller. <br /> (g) "Hotel" , having 35 rooms or more, may be licensed for the <br /> sale of beer and/or wine to be consumed upon the premises. <br /> (h) A "social club or fraternal organization" means a place <br /> where beer and/or wine is sold or kept for sale only in the club or <br /> fraternal rooms to the members of said club or fraternal organization, <br /> or their guests, which in no way caters to public patronage. <br /> - 1 - <br />
