But this proviso shall not apply to replacements of <br /> poles, erected and maintained by the grantee upon the public <br /> streets prior to the passage of this Ordinance; and provided, that <br /> whenever the City of ): Nrcrett shall pave any street, alley or high- <br /> way or portion thereof, or otherwise permanently improve the <br /> same, the said grantee , its successors or ',.ssigns, (if the City <br /> Council determines that it be necessary) , shall, at its option, <br /> immediately upon written notice so to do by said city, either <br /> remove and relocate LAay of the poles of the grantee so as to con- <br /> form to the new grade, and not obstruct the proposed improvements, <br /> or construct and lay down in advance of such improvement and in <br /> such way as not to delay or interfere witn the same , underground <br /> pipes or conduits in said street , alley or public highway, or <br /> portion thereof, so improved , and in such event shall lay or run <br /> its wires and other conductors therein, and forthwith remove <br /> from such portion of such street, alley or public highway any or <br /> all poles and the wires and other conductors therein and suspended <br /> therefrom and thereon, which it had theretofore erected, except <br /> such poles as are necessary for distribution of its wires and <br /> for carrying its long distance toll lines. <br /> Section 2: The exclusive use of space for the upper arm <br /> of all poles of the grantee owned and used in the City of verett <br /> exclusively by the grantee , shall be reserved for the use of the <br /> city of .:Iferett, if the City desires such use , for maintenance <br /> of its police and fire alarm telegraph system; and if unuerground <br /> conduits shall be owned and used by the grantee for carrying its <br /> wires Or cbles under the streets , or alleys of the City, there <br /> shall be reserved for the use of the said City of 7:verett for <br /> such purpose the joint use of one duct in such conduits. <br /> Section 6: The said grantee , its successors or resigns,• <br /> may make all necessary excavations in any of said streets , alleys <br /> or public highways for the purpose of erecting and maintaining <br /> -2- <br />
