No changes to the existing building <br /> footprint,single family residence or site work are proposed. <br /> BACKGROUND <br /> A nonconforming use certification, project file NCU88-004,was issued in 1988 for the subject parcel.The <br /> certification recognized an existing grocery store and detached single-family residence located on the <br /> property.The certification also recognized nonconforming front and side yard setbacks for the <br /> commercial building, a nonconforming rear setback for the detached single-family residence, and <br /> nonconforming parking for the commercial building. <br /> A request for change of nonconforming use is typically subject to a Review Process I. However, in <br /> accordance with EMC 15.02.060(B)(6),the Planning Director determined a Review Process II was most <br /> appropriate for this request due to the residential zoning designation and policies in the comprehensive <br /> plan calling for limiting encroachment by hospitals,clinics, and other related medical activities into <br /> residential neighborhoods(see,e.g., Land Use Policy 2.1.6). <br /> ANALYSIS <br /> While physical therapy and wellness could be considered a medical activity related to the hospital,the <br /> applicant indicates that much of the clientele is expected to be local and that the business will take steps <br /> to integrate with the neighborhood including holding community events. Furthermore,the building is <br /> already commercial,so this use would not displace any residences. <br /> Public notice was provided and a public comment period of 14 days was held for the project.Written <br /> comments were received from two parties during the comment period, both of whom requested more <br /> information on the proposal.
