CITY OF EVERETT
EVERETT Planning
WASHINGTON
Planning Director Decision
PROJECT DESCRIPTION
Project Type: Change of Nonconforming Use
Project File No.: REVII21-011
Owner: Jake Yun
Site Address: 1332 Colby Avenue, Everett WA 98201
Legal Description: EVERETT DIV R PLAT OF BLK 245-LOTS 17-18
Tax Parcel#: 00438524501700
Zoning: R-2,Single-Family Medium-Density Residential
REQUEST
The requested Change of Nonconforming Use proposes changing the existing nonconforming
grocery/indoor retail space into a physical therapy and wellness clinic. The R-2 zone prohibits offices—
clinics and as such a change of nonconforming use is required. No changes to the existing building
footprint, single family residence or site work are proposed.
BACKGROUND
A nonconforming use certification, project file NCU88-004,was issued in 1988 for the subject parcel. The
certification recognized an existing grocery store and detached single-family residence located on the
property. The certification also recognized nonconforming front and side yard setbacks for the
commercial building, a nonconforming rear setback for the detached single-family residence, and
nonconforming parking for the commercial building.
A request for change of nonconforming use is typically subject to a Review Process I. However, in
accordance with EMC 15.02.060(B)(6),the Planning Director determined a Review Process II was most
appropriate for this request due to the residential zoning designation and policies in the comprehensive
plan calling for limiting encroachment by hospitals, clinics, and other related medical activities into
residential neighborhoods(see,e.g., Land Use Policy 2.1.6).
ANALYSIS
While physical therapy and wellness could be considered a medical activity related to the hospital, the
applicant indicates that much of the clientele is expected to be local and that the business will take steps
to integrate with the neighborhood including holding community events. Furthermore, the building is
already commercial,so this use would not displace any residences.
Public notice was provided and a public comment period of 14 days was held for the project.Written
comments were received from two parties during the comment period, both of whom requested more
information on the proposal. Neither party had outright objections to the proposed use however one
cp
2930 Wetmore Ave,Ste 8-A 0 425.257.8731 ® planning@everettwa.gov
Everett,WA 98201 O 425.257.8742 fax everettwa.gov
I
