EASEMENT <br /> Grantor, Grantee specifically waives any immunity it may have under the State Industrial <br /> Insurance Law, Title 51 RCW. Grantee recognizes that this waiver of immunity under Title 51 <br /> was specifically entered into pursuant to the provisions of RCW 4.24.115 and was the subject <br /> of mutual negotiation. This Section survives any termination of the Easement. <br /> 5. Termination. The term of the Easement is perpetual unless terminated as set <br /> forth below: <br /> A. Violation of Easement. If Grantor believes that Grantee has violated any <br /> material covenant, term or condition herein, Grantor may deliver written notice thereof to <br /> Grantee. If Grantee does not cure such violation at no expense to Grantor within sixty (60) <br /> days after delivery of violation notice,then the Grantor may, effective upon written notice to <br /> Grantee, terminate the Easement. <br /> B. Public Convenience. If the City determines at its sole discretion that the <br /> public convenience requires use of the Easement Area inconsistent with Grantee's use of the <br /> Easement Area,the City may terminate the Easement effective upon six months prior written <br /> notice to Grantee. <br /> C. RCO Restrictions. Grantor's Property is subject to the terms and <br /> conditions of the deed between Snohomish County and the Grantor dated September 6, 1983, <br /> and recorded under Snohomish County Recorder's number 839160266, and may be subject <br /> other agreements referred to in or in connection with such deed, including without limitation <br /> the Project Agreement dated May 8, 1972 with the Committee for Outdoor Recreation <br /> (predecessor to the Washington State Recreation and Conservation Office ("RCO")) dated on <br /> or about June 30, 1971 (such deed and all such agreements collectively, the "RCO <br /> Agreements"). The Grantor does not believe that the Easement violates the RCO Agreements, <br /> but the Grantor makes no warranty whatsoever to Grantee about the RCO Agreements. In <br /> 4 <br />
