EASEMENT <br /> the event that the RCO or any other government authority other than the Grantor determines <br /> in its sole discretion that the Easement violates any provisions of the RCO Agreements, <br /> Grantor may terminate this Easement without any liability whatsoever to Grantee effective <br /> upon written notice to Grantee. <br /> 6. Title. Grantor does not warrant its title and ownership of the Grantor Property <br /> or the Easement Area nor warranty its right to convey and grant the rights and privileges <br /> herein provided and shall not be liable for defects thereto or failure thereof. <br /> 7. Covenant Running with the Land; Easement Appurtenant. Subject to the terms <br /> hereof, the Easement and the covenants, terms and conditions referenced herein shall be <br /> deemed covenants running with and encumbering the Easement Area, and shall be binding <br /> upon the Grantor's successors, grantees, and assigns with respect to the Easement Area. The <br /> Easement is appurtenant to the Grantee Property. <br /> 8. Miscellaneous. This Easement shall be construed under and governed by the <br /> laws of the State of Washington. Either party's failure to enforce any provision hereof shall <br /> not constitute waiver thereof in any future instance. If any provision hereof is held to be <br /> unenforceable to any extent, such provision shall be enforced to the maximum extent <br /> permitted by law and the remaining provisions shall continue in full force and effect.
