ORDINANCE NO. 2564 <br /> An Ordinance relating to and providing for the regulation of the sale, pos- <br /> session and use of intoxicating liquors in the City of Everett, for the licensing <br /> and regulating of the occupation of retail druggists in the business of filling <br /> prescriptions for intoxicating liquors in said city, repealing Ordinances No. <br /> 1775, 1847 and 2562, and all other ordinances or parts of ordinances in conflict <br /> therewith, providing a penalty for the violation of the provisions herewith, <br /> and declaring an emergency. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: The license provided for herein shall be for the purpose of <br /> raising revenue or for the purpose of regulation or for a combined purpose of <br /> regulation and raising revenue. In those cases in which the purpose is for re- <br /> gulation, the provisions of this Ordinance shall be deemed an exercise of the <br /> Police Power of the State of Washington and of the City of Everett for the pro- <br /> tection and preservation of public morality, health, peace and good order within <br /> the limits of said City, and all of its provisions shall be liberally construed <br /> for the accomplishment of this purpose . <br /> Section 2: If any section, paragraph, phrase, clause or sentence of this <br /> ordinance is for any reason held unconstitutional or void, such decision shall <br /> not affect the validity of the remaining portion of this ordinance . <br /> Section 3: The words "intoxicating liquors" wherever used in this ordinance <br /> shall be held and construed to include,whiskey, brandy, gin, rum, ale, wine, beer <br /> and any spirituous, vinous. fermented or malt liquor or liquid containing intoxi- <br /> cating properties which is capable of being used as a beverage . <br /> Section 4: It shall be unlawful for any person engaged in the occupation, <br /> business or profession of druggist or pharmacist in the City of Everett to fill <br /> a prescription for intoxicating liquors or to sell any spirituous, vinous, fer- <br /> mented or malt liquor, or liquid containing intoxicating properties which is <br /> capable of being used as a beverage, unless such person shall, on or before De- <br /> cember 31st, 1932, and on or before the 1st day of January of each succeeding <br /> year thereafter, first apply for and secure from the City Council of said City, <br /> a license permit to be known as a "Druggist License for the Sale of Intoxicating <br /> Liquors". The fee for the said license shall be the sum of $10 .00 per annum. <br /> Section 5: Any person desiring to procure such a license named herein shall <br /> first make written application to the Commissioner of Safety of said City, describ- <br /> ing the premises by street and number where said business is to be carried on, and <br /> -1- <br />
