CITY OF EVERETT SPECIAL PROVISIONS <br />Beverly Lake Water Quality Retrofit Division 1 – GENERAL REQUIREMENTS August 2023 <br />WO No – UP3745 SP – 103 <br />the City, the Contractor shall promptly reconstruct, repair, replace or restore all work <br />and/or materials so destroyed. Nothing herein provided for shall in any way excuse <br />the Contractor or its surety from the obligation of furnishing all the required materials <br />and completing the work in full compliance with the terms of the Contract. <br />1-07.20 Patented Devices, Materials, and Processes <br />Delete the first paragraph of 1-07.20 and substitute the following: <br />The Contractor shall assume all costs arising from the use of patented devices, <br />materials, or processes used on or incorporated in the Work, and agrees to indemnify, <br />defend, and save harmless the City, and its officers, employees and agents from all <br />actions of any nature for, or on account of the use of any patented devices, materials, or <br />processes. <br />1-07.23 Public Convenience and Safety <br />Delete the last sentence of the first paragraph of 1-07.23 and substitute the following: <br />Nothing contained in this Contract is intended to create any third-party beneficiary rights <br />in favor of the public or any individual utilizing the facilities being constructed or improved <br />under this Contract. <br />1-07.23(1) Construction Under Traffic <br />Revise the third sentence of the second paragraph to read as follows: <br />Do NOT impair accessibility to existing or temporary pedestrian push buttons. City <br />may allow activating pedestrian recall timing or other accommodations during <br />construction. <br />Supplement 1-07.23(1) by adding the following: <br /> <br />Full closure of 75th St SE shall be limited to the minimum duration required to <br />construct the proposed water quality treatment facility. Minimum one way traffic <br />shall be restored as soon as the facility is able to be backfilled. <br />If Engineer determines the permitted closure hours adversely affect traffic, the <br />Engineer may adjust the hours accordingly. The Engineer will notify the Contractor <br />in writing of any change in the closure hours. <br />No lane closures will be allowed on a holiday or holiday weekend, or after 12:00 <br />p.m. on a day prior to a holiday or holiday weekend. A holiday weekend is defined <br />as having a holiday fall on Friday, Saturday, Sunday or Monday. <br />Contractor shall notify the local Fire, Police and Engineering Departments before <br />the beginning of each phase of construction so that these agencies may re-route <br />their emergency vehicles around the construction zone. The non-emergency phone <br />number for Everett Police is 258-2484, for Fire Dispatch is 257-8757, and for Public <br />Works Engineering is 257-8800. <br />Contractor shall notify City of Everett Transit at 425-257-8984 and Community <br />Transit at 425-348-7100 of all street closures or delays at least 24 hours in advance <br />to enable rerouting of buses. <br />Contractor shall notify the property owners at least 72 hours in advance to enable them <br />to remove vehicles parked in the vicinity of Work. Towing vehicles shall be the <br />responsibility of the Contractor and no additional payment will be made. <br />Further supplement 1-07.23(1) by adding the following: <br />1-07.23(1)A General Requirements Traffic <br />(******) <br />The following general requirements apply to all Work on the Project:
