CITY OF EVERETT SPECIAL PROVISIONS <br />Beverly Lake Water Quality Retrofit Division 1 – GENERAL REQUIREMENTS August 2023 <br />WO No – UP3745 SP – 53 <br />Bidder acknowledges that Bidder has not relied on representation or warranty of the <br />City not expressly included in the Contract Documents. <br />The information provided by the City is not intended to be a substitute for, or a <br />supplement to, the independent verification by Bidder to the extent such <br />independent investigation of the Drawings and Specifications or Site conditions is <br />deemed necessary or desirable by the Bidder. Bidder acknowledges that they have <br />not relied upon City or Engineer furnished information regarding site conditions in <br />preparing and submitting a Bid. <br /> <br />Further supplement 1-02.4(1) by adding the following: <br />1-02.4(1)A Interpretation of Contract Documents <br />(******) <br />Should a Bidder find what is believed to be discrepancies in or omissions from the <br />Plans, Specifications, or Special Provisions, or should the Bidder be in doubt as to <br />their meaning, Bidder may submit to the Engineer a written request for an <br />interpretation thereof. The Bidder submitting the request will be responsible for its <br />prompt delivery. Any interpretation of the documents, if made, will be made only by <br />addendum duly issued and a copy of such addendum will be mailed or delivered to <br />each Bidder receiving a set of such documents. All requests for interpretations <br />must be received by the City or Engineer no later than 7 calendar days prior <br />to the Bid Opening Date. All questions regarding the Contract Documents shall <br />be referred to the City or Engineer at the address provided in the Contract <br />Documents. <br />1-02.4(1)B Prevailing Wages <br />(******) <br />Bidder is directed to 1-07.9(1) of these Special Provisions for requirements <br />regarding applying payment of prevailing wage rates for employment of labor on <br />within Snohomish County. <br />1-02.4(2) Subsurface Information <br />Delete the first paragraph and substitute the following: <br />If the City has made subsurface investigation of the site of the proposed Work, the <br />boring log data and soil sample test data accumulated by the City will be made <br />available for inspection by the Bidders. The boring logs and soil sample test data <br />shall NOT be considered as part of the Contract, regardless of whether such data <br />is supplied as an Appendix to the Special Provisions or not. In addition, the City <br />makes no representation or warranty expressed or implied that: <br />1. The Bidders’ interpretations from the boring logs are correct, <br />2. Moisture conditions and indicated water tables will not vary from those <br />found at the time the borings were made, and <br />3. The ground at the location of the borings has not been physically <br />disturbed or altered after the boring was made. <br />The City specifically makes no representations, guarantees, or warranties as to <br />the condition, materials, or proportions of the materials between the specific <br />borings regardless of any subsurface information the Contracting Agency may <br />make available to the prospective Bidders. <br />Supplement 1-02.4(2) by adding the following: <br />The boring log data and soil sample data, if any, can be found in Appendix A.
