CITY OF EVERETT SPECIAL PROVISIONS <br />Beverly Lake Water Quality Retrofit Division 1 – GENERAL REQUIREMENTS August 2023 <br />WO No – UP3745 SP – 83 <br />1-05.19 City-Contractor Coordination <br />(******) <br />1-05.19(1) Suggestions to Contractor <br />Nothing in these Contract Documents requires the City’s Representative to provide the <br />Contractor with direction or advice on how to do the Work, construction practices, or <br />means and methods. If the City’s Representative approves, suggests or recommends <br />any construction practice, means, method or manner for doing the Work or producing <br />materials, the approval or recommendation shall not: (A) guarantee that following the <br />method or manner will result in compliance with the Contract Documents; (B) relieve the <br />Contractor of any risks or obligations under the Contract Documents; or (C) create <br />liability by the City to the Contractor. <br />Suggestions as to the plans or methods of accomplishing the Work or Contract <br />requirements by the City or the City’s Representative to the Contractor but not specified <br />or required, if adopted or followed by the Contractor in whole or in part, shall be used at <br />the risk and responsibility of the Contractor. The City and the City’s Representative <br />assume no responsibility therefore and in no way will be held liable for any defects in <br />the Work which may result from or be caused by use of such plan or method of Work. <br />1-05.19(2) Meetings with City <br />The Contractor shall have its duly authorized representative attend periodic <br />informational meetings with the City’s Representative and City staff, as reasonably <br />required by the City. <br />Contractor, City, and City’s Representative shall meet as often as determined by the <br />City’s Representative, but no less often than once each month. The purpose of the <br />meeting is to review Project status in relation to the construction schedule; review value <br />of Work completed during the previous month; and, if applicable, review Contractor's <br />plans to return Project status to that required by the schedule. If requested by the City <br />or City’s Representative, the Contractor shall submit a written progress report within five <br />days following this meeting, comprising: <br />The current construction schedule indicating percent complete, actual completion or <br />start dates since the previous review, the estimated remaining duration for each activity <br />in progress, Schedule of Values update, and narrative summary. <br />Reasons any activities are behind schedule and the corrective steps being taken. <br />1-05.19(3) Cooperation with Others <br />The Contractor agrees to permit entry to the work site by the City, its employees or other <br />contractors performing Work on behalf of the City. The Contractor shall afford to the <br />City, other contractors and their employees, reasonable facilities and cooperation and <br />arrange its work and dispose of its materials in such a manner as to not interfere with <br />the activities of the City or of others upon the site of Work. The Contractor shall promptly <br />make good Contractor-caused injury or damage to persons or property that may be <br />sustained by other contractors or employees of the City. The Contractor shall join its <br />Work to that of others and perform its Work in proper sequence in relation to that of <br />others. <br />If requested by the Contractor, the City will arrange meetings with other contractors <br />performing Work on behalf of the City to plan coordination of construction activities. The <br />Contractor shall inform itself of the planned activities of other contractors and will <br />coordinate its Work with the other contractors. <br />Contractor shall notify the City of problems, interference or any difficulty with other <br />contractors or workers engaged by the City. The Notice shall be sufficiently prompt and <br />specific so as to allow the City to mitigate or avoid increased costs, time of performance,
