CITY OF EVERETT SPECIAL PROVISIONS <br />Beverly Lake Water Quality Retrofit Division 1 – GENERAL REQUIREMENTS August 2023 <br />WO No – UP3745 SP – 94 <br />at a daily rate from the date the Contractor was notified that the claim was allowed. <br />The City’s costs to enforce recovery of these amounts are additive to the amounts <br />owing. <br />The Contractor specifically assumes all potential liability for actions brought by <br />employees of the Contractor and, solely for the purpose of enforcing the defense and <br />indemnification obligations set forth in 1-07.14, the Contractor specifically waives any <br />immunity granted under the State industrial insurance law, Title 51 RCW. This waiver <br />has been mutually negotiated by the parties. The Contractor shall similarly require that <br />each Subcontractor it retains in connection with the project comply with the terms of this <br />paragraph, waive any immunity granted under Title 51 RCW, and assume all liability for <br />actions brought by employees of the Subcontractor. <br />The indemnity, defense and other obligations in this 1-07.14 are in addition to any <br />indemnity, defense or other obligation that may be contained elsewhere in the Contract <br />Documents. <br /> <br />1-07.15 Temporary Water Pollution Prevention <br /> <br />Delete the last section of 1-07.15(1) below the header “Payment” and replace with the <br />following: <br /> <br />Payment <br />(******) <br />Payment for bid items of Work completed pursuant to the Contract Documents will be <br />as described in Division B – Bid Item Descriptions of these Special Provisions and <br />Section 1-09 MEASUREMENT AND PAYMENT of the Standard Specifications as may <br />be amended by these Special Provisions. <br /> <br />1-07.16 Protection and Restoration of Property <br /> <br />Supplement 1-07.16(1)A with the following: <br />A survey monitoring plan shall be included to monitor the adjacent infrastructure <br />including the rockery along Beverly Lane and the portions of the existing wall to remain <br />adjacent to 75th St. SE. This should include a preconstruction survey of the condition of <br />existing improvements to establish the baseline condition, with special attention to <br />existing cracks and observed settlement in the adjacent sidewalks, walls and rockeries, <br />and buildings. <br /> <br />An optical survey monitoring program should be completed during excavation, shoring <br />installation and backfill. The baseline survey should be completed prior to any pavement <br />removal or excavations. The recommended frequency of monitoring should vary as a <br />function of construction activity and monitoring performance but should as a minimum <br />include: <br /> <br />Construction Stage Monitoring Frequency <br />During pavement removal, excavation and <br />backfill Three times per week
