• ORDINANCE NO: 2546. <br /> An Ordinance to prevent the fraudulent sale and to regulate the sale of goods, <br /> wares and merchandise; and to provide penalties for the violation thereof and re- <br /> pealing Ordinance No. 2341 and all other Ordinances and parts of Ordinances in con— <br /> flict herewith, and declaring an emergency . <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> An Ordinance to prevent the fraudulent sale and to regulate the sale of goods, <br /> wares and merchandise and to provide penalties for the violation thereof and repeal— <br /> ing Ordinance No. 2341 and all other Ordinances and parts of Ordinances in conflict <br /> herewith. <br /> Section 1. No person shall advertise, represent or hold out that any sale <br /> of goods, wares and merchandise A'an insurance, bankruptcy, mortgage, insolvent, <br /> assignee's, executor's,administrator's, receiver's, trustee's, removal or closing <br /> out sale or a sale of goods, wares and merchandise damaged by fire, smoke, rater or <br /> otherwise, in the City of Everett, unless he shall have first obtained a license to <br /> conduct sucn sale from the Clerk of the City of Everett . <br /> Section 2. "Person", as used in this Ordinance, shall include any person, <br /> firm or corporation in the City of Everett. The manager of any firm or corporation <br /> shall be deemed responsible for the obtaining of such license as well as such person, <br /> firm or corporation. <br /> Section 3. The applicant shall submit to such Clerk, in writing, a state— <br /> ment showing all the facts in regard to the contemplated sale, with a statement as <br /> to the reasons for such closing out, an. inventory of goods showing actual purchase <br /> price, names of persons from whom goods were obtained , date of delivery of such <br /> goods and all details necessary to fully identify the goods to be sold. <br /> Section 4. The license fee for such sale shall be the sum of f25.00, plus <br /> $$2.00 for each thousand or fraction thereof of the submitted inventory, for a period <br /> of three months. <br /> Section 5. Such application shall specify the period of time during which <br /> the sale may continue. This time shall not exceed three months, but if at any time <br /> during three months a sworn application be filed with the City Council making it ap- <br /> pear that all the goods in the original inventory have not been sold, accompanied by <br /> an inventory of what remains showing actual purchase price, a supplemental license <br /> may be issued, in the discretion of the Council , upon compliance by the applicant with <br /> the requirements of the original issue and upon the payment of an additional license <br /> fee of 025.00 per day, which license shall continue in effect only as long as said daily <br /> license fee shall be paid and he shall comply with the provisions of this Ordinance. <br /> Any application for a license under the provisions of this Ordinance covering <br />
