IM <br /> Section 3. That the grantee herein,before making any excavation in <br /> any of the streets,alleys or other public places of said City, shall file <br /> with the Commissioner of Public Works of said City, a plan showing the <br /> particular streets,alleys or other public places and the particular part <br /> thereof that it desires to occupy and a particular specification of the <br /> pipe,conduits,structures,apparatus,connections and appurtenances it desires <br /> to put in said place or places,together with a definite location of all <br /> such and said grantee shall not have authority to proceed with any of said work <br /> until the Commissioner of Public Works and the City Council shall approve <br /> of such plan,either as presented or as by him or the City Council modified <br /> or amended,and shall have granted a permit therefor. All world done and material <br /> used by the grantee hereunder shall be first class in every respect. <br /> In prosecuting the work of laying down such pipes, conduits,struct- <br /> ures,apparatus and appurtenances,the grantee herein shall not make excavat- <br /> ions in any of the streets,alleys or other public places, for a distance <br /> exceeding three blocks at a time unless and until permission for a greater <br /> distance has been given by the council and upon completing such work shall <br /> leave such streets,alleys or other public places in as good repair as the <br /> same were in before making the excavations and if the grantee shall fail so <br /> to do,the City shall have the right to put such streets,alleys and public <br /> places in as good repair as they were before the making of such excavations <br /> and the cost and expense thereof shall be charged to said grantee and prompt- <br /> ly repaid by said grantee upon the presentation of an itemized and verified <br /> statement of costs thereof and shall be a lien upon all of the property of <br /> said grantee until paid. All excavations and materials placed or caused to <br /> be placed upon any street,alley or other public place by the grantee shall be <br /> carefully guarded by grantee so as to prevent accident. <br /> The Grantee shall indeminify and save harmless the City against any <br /> and all loss and assume all liability for claims which arise against the City <br />
