r <br /> Provided, however, that no such permit shall be granted until the <br /> the applicant shall have deposited with the City Clerk, the 13um of <br /> ten dollars ( 10.00) in cases where a wooden sidewalk, and twenty- <br /> five dollars (42b.00) in cases. where a cement sidewalk runs along that <br /> portion of the street to be occupied, as further security for the <br /> immediate restoration of such talk to as good a condition as the same <br /> was before the granting of said permit. Such deposits shall be kept <br /> by said Clerk, until a written statement shall have been filed, <br /> signed by the Street superintendent, certifying that such walk has <br /> been so restored. <br /> Secti :�i .. . No person having or obtaining a permit as herein <br /> provided shall place any obstruction to the free Passage of water <br /> in any gutter of any street, avenue, or alley or within three feet <br /> therefrom, or so place any material that the same is liable to be <br /> washed into any gutter by rain; provided, however, that th , City <br /> Council may grant written permits to builders and contractors for <br /> their convenience to place temporary bridges over any gutter, suf- <br /> ficient for the free passage/thereunder of all surface water. No <br /> building materials, rubbish or other material shall be allowed within <br /> a reasonable distance , fire plugs in such manner as to obstruct free <br /> access to the same. >•• <br /> Section -- Every person to whom such permission is granted <br /> shall cause a 1 imber, building materials and rubbish arising there- <br /> from to be removed from,/ the street, avenue, alley sr public place <br /> at the e+n piration of the time limited, as herein provided. Provided, <br /> that if before the expiration of the time limited, it shall be no <br /> longer necessary to keep such street, avenue, alley or public place <br /> obstructed, and in any case, within five days after the workmen <br /> shall have finished their work on the building, all obstructions <br /> shall be removed fro: /such street, avenue, alley or public place. <br /> Section any person violating any of the provisions of <br /> this ordinan`c s all be deemed guilty of a misdemeanor, and upon <br /> conviction thereof shall be punished by a fine in any sum not <br /> exceeding three hundred dollars ( 300) or by imprisonment for any <br /> period not exceeding ninety days, or by both such fine and imprison- <br /> ment for each offense. Each and every twenty-four hours that such <br /> materials or huildings shall be permitted to remain or be in any <br /> such street, avenue, alley or other public place aithoi;.t the permit <br /> of license herein required, shall be deemed a separate offense under <br /> this ordinance. And each and every forty-eight hours such building <br /> or materials and rubbish herein specified shall be allowed to remain <br /> upon said street, avenue, alley or public place after the expiration <br /> of the time limited in such permit or license or after the same has <br /> been revoked, as herein provided, or after the necessity for further <br /> ob$tructing sa' d ,street has ceased of after the five days mentioned <br /> in Cecti on _ -- as this ordinance shall have elapsed, shall be <br /> deemed a separate offense under this ordinance. <br /> ae • n ;� : , C d' nc _ of • c . a -- <br /> ner din es a parts ornces • conf _ he :.ith be, are <br /> h : -Line a e hereby repealed. <br />
