and for eighteen inches on each side of the rails, that the same may be readily crossed at any portion thereof by teams and wagons. (b) In the event that said Nassau Street and Everett Avenue, or either said street or said avenue, or any portion thereof, used by such grantee or its assigns under said fran- chise , shall be abandoned by such grantee or its assigns, the said grantee or its assigns shall forthwith be required to re- move its tracks and other property therefrom, and at the time of such removal restore , repair or reconstruct that portion of said Nassau Street and Everett Avenue, or any portion thereof dis- turbed by such removal, so that the same shall conform to the general condition of said Nassau Street and Everett Avenue at the time of such removal. (e) The grade of the streets upon which these railway tracks may be constructed under this franchise may be altered or changed by the City of Everett, and upon the city's causing the surface of any such streets to be brought to the level of such altered or changed grade, the grantee or its assigns shall at its or their cost, cause its or their railway to be changed so as to conform to such changed grade of such street. (d) In the event that electricity shall at any time be used as a motive power hereunder, the grantee or its assigns shall use such means and appliances as will, as nearly as pos- sible, control and contain the currents of such electricity in their proper channels, and said grantee or its assigns shall at its or their expense change and improve such means and appliances from time to time as may be necessary to accomplish said purpose . (e) The City Council may, by ordinance , forfeit this franchise in the event that the grantee or its assigns shall, after notice from the city requiring it so to do , fail to comply with any of the provisions or conditions herein within sixty (60) days from the date of such notice. --3.
