way of the Great Northern Railway Company and the Northern <br /> .Eacific Railway Company. <br /> Section 2. In the operation of the track or tracks <br /> authorized by this ordinance said grantee, its successors and <br /> assigns, shall have the right to use steam power or any other <br /> motive power that they, or either of them, may deem suitable , <br /> subject to the reasonable control and regulation of the City of <br /> Everett. <br /> Section 3 . The grant in this ordinance obtained is <br /> made expressly subject to the following conditions and require- <br /> ments: <br /> (a) The grantee , its successors and assigns, in con- <br /> structing said railway shall not tear up any street or obstruct <br /> the travel thereon, any further than is unavoidable and shall <br /> keep such railway at all times in good repair, and upon the com- <br /> pletion of any portion of its tracks shall leave the street in as <br /> good condition for travel as the same was before such work was <br /> done , and that to whatever extent the City of Everett shall cause <br /> any portion of said street upon which any :kart of said railway <br /> shall have been laid down to be paved, macadamized, or planked or <br /> repaved, remacadamized or replanked said grantee , or its assigns, <br /> shall at the same time , ai its expense pave , or macadamize or <br /> plank the same, and keep the same in repair within and between <br /> the rails and for one foot on the outside of the outside rails <br /> of its tracks, in the same manner and at the same level and with <br /> the same material as shall be used in paving or planking the rest <br /> of said street , provided that the portion of said street to be <br /> so improved by said grantee , or its assigns, may be improved with <br /> pavement of such kind and character as may meet with the approval <br /> of the City Council, and on streets or portions of streets which <br /> are not paved, planked or macadamized, the owner of such railway <br /> shall maintain and plank its tracks between the rails thereof, <br /> -2- <br />
