City of Everett 00 2113 - 4 <br />2024 WPCF Biosolids Removal UT 3826-2 <br /> <br /> <br />00 2113 - 4 INSTRUCTIONS TO BIDDERS <br />The Bidder agrees that the City shall not be liable to it on any claim for additional <br />payment or additional time or any claim whatsoever if the claim directly or <br />indirectly results from the Bidder’s failure to investigate and familiarize itself <br />sufficiently with the conditions under which the Contract is to be performed. <br />The Bidder shall be familiar and comply with all Federal, State, tribal, and local <br />laws, ordinances, and regulations which might affect those engaged in the Work. <br />The City will not consider any plea of misunderstanding or ignorance of such <br />requirements. <br />Bid prices shall include everything necessary for the completion of the Work <br />including, but not limited to, providing the materials, equipment, tools, plant and <br />other facilities, and the management, superintendence, labor, and all necessary <br />testing services. <br />Prospective Bidders are advised that projects with Work on or adjacent to water <br />may require insurance coverage in compliance with: <br />1. The Longshoremen’s and Harbor Worker’s Compensation Act <br />(administered by U.S. Department of Labor), or <br />2. The State Industrial Insurance (administrated by the Washington <br />State Department of Labor and Industries), or <br />3. Both. <br />The Contractor shall bear all cost for such insurance as provided in the Contract <br />Documents. <br />No Claim shall be allowed because of any ambiguity in the Contract if: <br />1. The Bidder discovers an ambiguity but fails to notify the City, or <br />2. The Bidder failed to discover a patent ambiguity that would be <br />discovered by a reasonably prudent contractor in preparing its Bid. <br />Any prospective Bidder desiring an explanation or interpretation of the Bid <br />Documents, shall request the explanation or interpretation in writing by close of <br />business seven business days preceding the Bid opening to allow a written reply <br />to reach all prospective Bidders before the submission of their Bids. <br />Bidder acknowledges that the Bidder has not relied on representation or warranty <br />of the City not expressly included in the Contract Documents. <br />The information provided by the City is not intended to be a substitute for, or a <br />supplement to, the independent verification by the Bidder to the extent such <br />independent investigation of the Drawings and Specifications or Site conditions <br />is deemed necessary or desirable by the Bidder. Bidder acknowledges that they <br />have not relied upon City or Engineer furnished information regarding site <br />conditions in preparing and submitting a Bid. <br />1-02.4(1)A Interpretation of Contract Documents <br />Should a Bidder find what is believed to be discrepancies in or omissions <br />from the Plans, Specifications, or any other Contract Document, or should <br />the Bidder be in doubt as to their meaning, Bidder may submit to the City a <br />written request for an interpretation thereof.
