1,000 square feet. The basis for denial is incompatibility with the dwelling and/or <br /> neighborhood character. To make this determination, the Hearing Examiner may <br /> look to such factors that include, but are not limited to, view obstruction, aesthetic <br /> impact on surrounding properties and streetscape, incompatible scale with <br /> dwellings on surrounding properties, and impact on neighborhood character. The <br /> Hearing Examiner shall also have the authority to impose greater setback <br /> requirements, landscape buffers, or other locational or design requirements as <br /> necessary to mitigate the impacts of accessory buildings which are larger or taller <br /> than otherwise allowed by this Section. <br /> 1. On lots containing a minimum lot area of 18,000 square feet,the Hearing <br /> Examiner may allow the total square footage of all accessory buildings, including <br /> both attached and detached accessory structures,to exceed 1,000 square feet, <br /> subject to all of the following requirements; and <br /> 2. The total square footage of all accessory building(s), whether attached or <br /> detached, shall not exceed 15 percent of the lot area; and <br /> 3. The footprint of all detached accessory building(s) shall not exceed the square <br /> footage of the lesser of: <br /> a. the square footage of the footprint of the dwelling together with up to <br /> 500 square feet of its attached garage, if any; or <br /> b. 2,000 square feet; and. <br /> 4. Detached accessory buildings exceeding the size limitations of Subsection B of <br /> this Section shall not be located between the dwelling and any adjoining street, <br /> not including an alley; and <br /> 5. A covenant acceptable to the City Attorney's office shall be recorded on the <br /> title to the property stating that the property owner acknowledges the <br /> requirements of this section, and stating that the use of any accessory structure is <br /> limited to accessory activities permitted by the zone in which the property is <br /> located, and that the accessory building shall not be converted to living area or <br /> used for any purposes which are not in full compliance with zoning and building <br /> code requirements. <br />
