CITY OF EVERETT - CITYWIDE BICYCLE WAYFINDING <br />STATE FUND# HLP-PB21(014) <br />WO#3786 September 25, 2023 <br /> 2 <br /> 1 <br />1-01.3.RTF 2 <br />1-01.3 Definitions 3 <br />(January 19, 2022 APWA GSP) 4 <br /> 5 <br />Delete the heading Completion Dates and the three paragraphs that follow it, and replace 6 <br />them with the following: 7 <br /> 8 <br />Dates 9 <br />Bid Opening Date 10 <br />The date on which the Contracting Agency publicly opens and reads the Bids. 11 <br />Award Date 12 <br />The date of the formal decision of the Contracting Agency to accept the lowest 13 <br />responsible and responsive Bidder for the Work. 14 <br />Contract Execution Date 15 <br />The date the Contracting Agency officially binds the Agency to the Contract. 16 <br />Notice to Proceed Date 17 <br />The date stated in the Notice to Proceed on which the Contract time begins. 18 <br />Substantial Completion Date 19 <br />The day the Engineer determines the Contracting Agency has full and unrestricted use 20 <br />and benefit of the facilities, both from the operational and safety standpoint, any 21 <br />remaining traffic disruptions will be rare and brief, and only minor incidental work, 22 <br />replacement of temporary substitute facilities, plant establishment periods, or 23 <br />correction or repair remains for the Physical Completion of the total Contract. 24 <br />Physical Completion Date 25 <br />The day all of the Work is physically completed on the project. All documentation 26 <br />required by the Contract and required by law does not necessarily need to be furnished 27 <br />by the Contractor by this date. 28 <br />Completion Date 29 <br />The day all the Work specified in the Contract is completed and all the obligations of 30 <br />the Contractor under the contract are fulfilled by the Contractor. All documentation 31 <br />required by the Contract and required by law must be furnished by the Contractor 32 <br />before establishment of this date. 33 <br />Final Acceptance Date 34 <br />The date on which the Contracting Agency accepts the Work as complete. 35 <br /> 36 <br />Supplement this Section with the following: 37 <br /> 38 <br />All references in the Standard Specifications or WSDOT General Special Provisions, to 39 <br />the terms “Department of Transportation”, “Washington State Transportation 40 <br />Commission”, “Commission”, “Secretary of Transportation”, “Secretary”, “Headquarters”, 41 <br />and “State Treasurer” shall be revised to read “Contracting Agency”. 42 <br /> 43 <br />All references to the terms “State” or “state” shall be revised to read “Contracting Agency” 44 <br />unless the reference is to an administrative agency of the State of Washington, a State 45 <br />statute or regulation, or the context reasonably indicates otherwise. 46 <br /> 47 <br />All references to “State Materials Laboratory” shall be revised to read “Contracting Agency 48 <br />designated location”. 49 <br /> 50
