CITY OF EVERETT - CITYWIDE BICYCLE WAYFINDING <br />STATE FUND# HLP-PB21(014) <br />WO#3786 September 25, 2023 <br /> 16 <br />required, and costs for repair and replacement of work of others destroyed or damaged by 1 <br />correction, removal, or replacement of the Contractor’s unauthorized work. 2 <br /> 3 <br />No adjustment in contract time or compensation will be allowed because of the delay in 4 <br />the performance of the work attributable to the exercise of the Contracting Agency’s rights 5 <br />provided by this Section. 6 <br /> 7 <br />The rights exercised under the provisions of this section shall not diminish the Contracting 8 <br />Agency’s right to pursue any other avenue for additional remedy or damages with respect 9 <br />to the Contractor’s failure to perform the work as required. 10 <br /> 11 <br /> 12 <br />1-05.11.RTF 13 <br />1-05.11 Final Inspection 14 <br /> 15 <br />Delete this section and replace it with the following: 16 <br /> 17 <br />1-05.11 Final Inspections and Operational Testing 18 <br />(October 1, 2005 APWA GSP) 19 <br /> 20 <br />1-05.11(1) Substantial Completion Date 21 <br /> 22 <br />When the Contractor considers the work to be substantially complete, the Contractor shall 23 <br />so notify the Engineer and request the Engineer establish the Substantial Completion 24 <br />Date. The Contractor’s request shall list the specific items of work that remain to be 25 <br />completed in order to reach physical completion. The Engineer will schedule an inspection 26 <br />of the work with the Contractor to determine the status of completion. The Engineer may 27 <br />also establish the Substantial Completion Date unilaterally. 28 <br /> 29 <br />If, after this inspection, the Engineer concurs with the Contractor that the work is 30 <br />substantially complete and ready for its intended use, the Engineer, by written notice to 31 <br />the Contractor, will set the Substantial Completion Date. If, after this inspection the 32 <br />Engineer does not consider the work substantially complete and ready for its intended use, 33 <br />the Engineer will, by written notice, so notify the Contractor giving the reasons therefor. 34 <br /> 35 <br />Upon receipt of written notice concurring in or denying substantial completion, whichever 36 <br />is applicable, the Contractor shall pursue vigorously, diligently and without unauthorized 37 <br />interruption, the work necessary to reach Substantial and Physical Completion. The 38 <br />Contractor shall provide the Engineer with a revised schedule indicating when the 39 <br />Contractor expects to reach substantial and physical completion of the work. 40 <br /> 41 <br />The above process shall be repeated until the Engineer establishes the Substantial 42 <br />Completion Date and the Contractor considers the work physically complete and ready for 43 <br />final inspection. 44 <br /> 45 <br />1-05.11(2) Final Inspection and Physical Completion Date 46 <br /> 47 <br />When the Contractor considers the work physically complete and ready for final inspection, 48 <br />the Contractor by written notice, shall request the Engineer to schedule a final inspection. 49 <br />The Engineer will set a date for final inspection. The Engineer and the Contractor will then 50 <br />make a final inspection and the Engineer will notify the Contractor in writing of all 51 <br />particulars in which the final inspection reveals the work incomplete or unacceptable.
