The floor area cannot exceed the lesser of(a) 15%of the lot area—it is about 10%of the lot area; (b) <br /> 75%of the gross floor area of the 6,075 s.f. principal building it is about 32%;and(c)2,000 s.f. Given <br /> the large lot size and:floor area,this is the limiting factor. The proposed 1,925;s.f. building does not <br /> exceed this threshold. <br /> 3. The accessory building shall not be located between the principal building and the adjoining streets.The <br /> site is a through-lot with two frontages,View Drive provides access to the lot. The garage will not be <br /> between the house and View Drive,but will be between the house and Broadway to the east. Broadway <br /> is isolated from the site by topographical differences—an approximate 14 foot high embankment between <br /> Broadway and the east property line, by horizontal distances—30 feet from the roadway to the property <br /> line and another 20 feet to the proposed garage, and by dense vegetation on the steep slope between the <br /> road and property. <br /> DECISION <br /> The City of Everett Planning Director grants APPROVAL of the request for an increase in the accessory <br /> building height from 15 feet to 19.5 feet and building footprint from 1,000 s.f.to 1,925 s.f: <br /> The following conditions shall apply: <br /> 1 Any change to the design, height,square footage and/or roof pitch of the proposed garage requires <br /> Planning Director approval. Construction permits,inspections and approvals must be obtained for the <br /> structure in accordance with established zoning and building code requirements. <br /> 2. A covenant acceptable to the City Attorney's office shall be recorded on the title of the <br /> property stating that the property owner acknowledges the requirements of EMC 19.07.020,and stating <br /> that the use of any accessory structure is limited to accessory activities permitted by the zone in which <br /> the property is located,and that the accessory building shall not be converted to living area or used for <br /> any purposes which are not in full compliance with zoning and building code requirements. <br /> 3. The garage's siding and roofing material must be compatible with the dwelling. <br /> 4. A height survey may be required at the time of framing. <br /> 5. Height calculations showing the actual height measured from the average base elevation will be required <br /> on the site plan and elevations at the time of building permit submittal in accordance with the Sample <br /> Reside 'al Checklist. <br /> Date 3 0 / ' <br /> Allan Giffen, Dire` r <br /> Planning and Co tinnily Development Department <br /> If a complete application has not been filed for a building permit or equivalent construction permit within <br /> eighteen(18)months from the approval date of this decision,the permit shall be deemed terminated, unless <br /> an extension is granted. If the permittee requests an extension in writing not later than eighteen(18)months <br /> from the land use permit date,the Director may grant a six(6)month extension. <br /> This is an administrative decision that may be appealed to the City's Land Use Hearing Examiner. An appeal <br /> must be filed with the City within 14 days of the date of this notice.
