*** <br /> Development and use of the shorelines of Everett shall be subject to the following <br /> requirements: <br /> *** <br /> 2.Substantial development permit. No substantial development shall be undertaken on the <br /> shorelines of Everett without first obtaining a shoreline permit from the city. Substantial <br /> development is defined in RCW 90.58.030(3)(e).Substantial development generally includes <br /> development which exceeds a total cost or fair market value of$7,047,or any development <br /> which materially interferes with the normal public use of the water or shorelines of the state. <br /> *** <br /> The unpermitted clearing,grading and development activities on the site without required Public Works <br /> Permits are violations of Everett Municipal Code(EMC) 13,76,which adopts the Design and <br /> Construction Standards and Specifications for Development—as written within that document, <br /> Volume I,Section 1-7: Permits.The site development further failed to meet minimum requirements to <br /> manage Surface and Stormwater Drainage as described within EMC Section 14.28.The codes here <br /> referenced and applicable links are shown below. <br /> • EMC 13.76.010 Development and dissemination. <br /> The mayor and/or the director of public works is hereby authorized to develop,disseminate, <br /> revise and update design and construction standards and specifications for utility work,work in <br /> the public right-of-way or in easements,and all other work performed pursuant to construction- <br /> related permits issued by the city of Everett. (Ord. 898-82§ 1, 1982.) <br /> 2023 DESIGN AND CONSTRUCTION STANDARDS AND SPECIFICATIONS <br /> Volume I,Section 1-7 <br /> 1-7 PERMITS A permit is required for all work within the public right-of-way and city utility <br /> easements,and for all work on private property, including but not limited to;sewer,water, and <br /> drainage improvements,fill and excavation, parking lot construction, retaining walls and/or <br /> paving.Consult with City of Everett Permit Service for the appropriate type of permit and its <br /> required documents. <br /> *** <br /> EMC 14.28.030 Requirements for development,redevelopment and construction activities. <br /> A. Applicability.This chapter is applicable to discharges to stormwater,surface water,or ground <br /> water.The design,construction and maintenance requirements and standards on all projects <br /> subject to this chapter shall meet or exceed the thresholds,definitions and criteria contained in <br /> the following, in the following order of precedence: <br /> 1. This chapter;and <br /> 2. City of Everett Design and Construction Standards and Specifications for Development;and <br /> 3. The Stormwater Management Manual for Western Washington. <br /> A Construction Stormwater General Permit,administered by the Department of Ecology(DOE),will be <br /> required for this project if it will disturb an acre or more of land.
