A Hearing Examiner Order was issued,for these violations and further development, on October 15, <br /> 2020.The Order required full abatement of violations by April 15,2021 (Case CE20-0017).The violations <br /> have not been abated. <br /> An inspection of the property on May 3, 2023 revealed the property remains fenced and gated with a <br /> large amount of business stock, materials and equipment on the property. More than a dozen shipping <br /> containers were stored on the property and several containers were used to create a larger covered <br /> structure that sheltered a large vessel.This large structure far exceeds a footprint of 200 sf and had <br /> been constructed without a required Building permit.Several vehicles are also stored on the property <br /> and one or more are under repair.Three large vessels were moored along the riverside with docks <br /> and/or pedestrian ramps installed,and some utilities extended. Electrical service and meters were <br /> installed/mounted on a shipping container near the SE portion of the site.A search of City records did <br /> not reveal permits for the alterations on the property—though the current owner did apply for a Public <br /> Works Permit in Year 2021(PWW2104-002).The application was incomplete and the permit has not <br /> been issued nor any of the violations abated. <br /> The unpermitted alterations within a floodway area and a critical area and/or critical area buffer are <br /> violations of Everett Municipal Code(EMC) 19.30.030 B&19.37.040(A&D)which read: <br /> • EMC 19.30.040 Compliance. <br /> All development within special flood hazard areas is subject to the terms of this chapter and <br /> other applicable regulations. No structure or land shall hereafter be constructed, located, <br /> extended,converted,or altered without full compliance with the terms of this chapter and <br /> other applicable regulations. Enforcement of the provisions of this chapter shall be performed in <br /> accordance with the procedures established in Chapter 1.20 EMC. (Ord.3766-20§9(Exh.A), <br /> 2020.) <br /> • EMC 19.37.040 Critical area features. <br /> On all lots containing or within three hundred feet of critical areas,the following features and <br /> their buffers shall not be altered or developed except as otherwise permitted by this chapter: <br /> A. Areas of special flood hazard (if located in a designated floodplain, also see <br /> Chapter 19.30 EMC); <br /> D.
