Do not click links or open <br />attachments unless you recognize the sender and know the content is safe. <br />Hi Grace, <br />Verizon respectfully does not recognize the Notice of Incomplete Application, and the 60-day shot clock <br />continues to run. The proposal is an Eligible Facilities Request under Section 6409 of the federal <br />Spectrum Act and Federal Communications Commission ("FCC") rules. The review of this application <br />must be done under the guidelines of the Spectrum Act, which supersede the scope and conditions under <br />SMA03-008 and SPU03-014. If the application does not comply with the Spectrum Act please issue a <br />denial letter based on that specific criteria. <br />Attached is a copy of my 6409 submittal letter, as well as a copy of 47 CFR 1.6100. Please review the <br />proposal under these guidelines, which allows up to a 20' increase in tower height. The building permit materials submitted with your application <br />stated the original project received land use approvals under SMA03-008 and SPU03-014, these <br />approvals were a Substantial Development Shoreline Permit with a Special Property Use approval <br />and Variance. The current proposal is subject to the scope and conditions of these original <br />approvals. The additional height to the existing flagpole/WCF tower being proposed under the <br />current permit application is not covered in the original approval and is considered a substantive <br />change to the shoreline permit per WAC 173-27-100. A formal shoreline permit revision request <br />must be submitted to the Planning Department for consideration. <br />
