Good Afternoon David, <br /> Thank you for your submittal for a proposed Detached Accessory Dwelling Unit (DADU) at 3430 Norton, Project File <br /> REVl21-027. My understanding is that the Historic Commission reviewed your proposal earlier this week and approved <br /> the design.Although the design has been approved by the HC, the application is still considered Active and there are <br /> remaining steps to take prior to final approval and construction: <br /> 1. A construction permit is required and typically processed concurrently with the REVI land use application.To <br /> date, it does not appear a construction permit application has been submitted. Please refer to the Permit <br /> Services website for minimum residential construction submittal requirements and permit submittal procedures. <br /> 2. The Historic Commission's review and approval was for the design of the proposed DADU only and should not be <br /> considered final approval of the project for construction. While the design of the proposed DADU does appear <br /> to meet most of the general and historical requirements outlined in EMC 19.08.100, it does not meet the <br /> minimum setback requirements.The proposed DADU must be placed at minimum 5' from the rear and side <br /> property lines in accordance with EMC 19.06. Since shifting the structure would not affect the design, there is no <br /> need to bring the proposal back to the historical commission for review. Note: EMC 19.38.030.C.2 allows for <br /> detached accessory structures with nonconforming setbacks be demolished and built in the same location <br /> provided the requirements of that section could be met, however this would allow for reconstruction of a new <br /> residential accessory building only i.e. garage, carport, shed, etc. and not for an accessory dwelling unit which is <br /> defined separately. <br /> 3. An Accessory Dwelling Unit Covenant must be recorded with the County Auditor's office prior to issuance of <br /> your construction permit. Please refer to page 7 of the ADU Checklist for reference; please email or drop off a <br /> copy of the covenant for my review prior to recording with the County Auditor. <br /> If you have any questions about these items or other Planning related requirements, please let me know and I'm happy <br /> to be of assistance.
