surface without a Public Works Permit and approvals,the storage of damaged and inoperable vehicles <br /> without required covers and within public view,vehicle maintenance and repairs conducted without <br /> required cover and containment,a lack of compliant storage of liquid waste and deposits of vehicle <br /> fluids upon exposed surfaces(illicit discharge of associated fluids and/or debris),and accumulation of <br /> garbage,junk,vehicle parts, rubbish, litter and noxious vegetation. <br /> Inspections of the property on August 14,2023, revealed some of the damaged and inoperable vehicles <br /> had been removed, large portions of noxious vegetation had been removed,junk&litter removed from <br /> most of the parking areas,and a majority of the oil-soaked hillside had been removed.While conditions <br /> have improved-all types of violations remain including, many inoperable or damaged vehicles remain <br /> uncovered and some apparently under repair in public view(with hoods up in lower lot),damaged <br /> vehicles remain uncovered and exposed to the weather—lacking both cover and containment,one <br /> barrel of waste oil remains and lacks compliant secondary containment control,spill absorbent material <br /> in the shop area needs to be swept up, and noxious vegetation remains along the south lot line and <br /> some accumulation of discarded items and rubbish are present.Additionally, no permits have been <br /> sought for the unpermitted alterations to the,landscape and parking areas,fencing,and sign violations, <br /> such that it is unlikely permits can be gained and abatement for these issue completed by the <br /> compliance date of September 20,2023. <br /> The removal of previously approved landscaping, creation of a freestanding sign and additional sign <br /> alterations on the structures,and the lack of compliant fencing without required permits and/or <br /> approvals are violations of Everett Municipal Code (EMC)19.35.080.A, 19.36.020.A and 19.40.010.D.1, <br /> which read: <br /> • EMC 19.35.080 Outdoor display and off-street parking area landscape requirements. <br /> The following requirements shall apply to landscaping of all off-street parking,outdoor <br /> automobile sales and outdoor display areas,except as otherwise provided in this title for <br /> specific zones.The purpose of this section is to provide visual relief along the street frontage of <br /> outdoor display and off-street parking areas,to prevent a monotonous visual experience of <br /> large expanses of paving,to create shade and mitigate the heat island effect of paved parking <br /> areas,to improve water quality,to improve stormwater management,to help control the flow <br /> of traffic,and to soften the appearance of parking structures. <br /> A. Parking and storage areas,automobile sales lots and other outdoor display areas which front <br /> on a street right-of-way shall provide the required landscaping in Table 35-2. <br /> EMC 19.36.020 Permit administration. <br /> A. Permits Required. Except as exempted in subsection B of this section, no sign shall be <br /> erected, re-erected, attached, structurally altered,or relocated by any person,firm or <br /> corporation without a sign permit issued by the city.Sign permit applications shall be submitted <br /> to the building official,with approval required by the planning department.All signs shall be <br /> subject to review by the city engineer to determine that there will be no hazards created for <br /> motorists or pedestrians. <br /> *** <br /> 19.40.010 Fences height and location. <br /> *** <br /> Notice and Order Page 2 of 8 <br />
