D. Commercial and Industrial Zones. Fences in commercial and industrial zones shall not exceed <br /> ten feet in height, including barbed wire located on top of the fence except: <br /> 1. Any fence taller than forty-two inches must be set back a minimum of ten feet or the <br /> required landscape width,whichever is greater,from any lot line along a street; and <br /> *** <br /> The unpermitted creation and alteration of parking surfaces and hard surfaces on the property without <br /> a required Public Works Permits are violations of Everett Municipal Code(EMC) 13.76, which adopts the <br /> Design and Construction Standards and Specifications for Development—as written within that <br /> document,Volume I,Section 1-7: Permits,which read: <br /> • EMC 13.76.010 Development and dissemination. <br /> The mayor and/or the director of public works is hereby authorized to develop, disseminate, <br /> revise and update design and construction standards and specifications for utility work,work in <br /> the public right-of-way or in easements,and all other work performed pursuant to construction- <br /> related permits issued by the city of Everett.(Ord. 898-82 § 1, 1982.) <br /> 2023 DESIGN AND CONSTRUCTION STANDARDS AND SPECIFICATIONS <br /> Volume I,Section 1-7 <br /> 1-7 PERMITS A permit is required for all work within the public right-of-way and city utility <br /> easements,and for all work on private property, including but not limited to; sewer,water, and <br /> drainage improvements,fill and excavation, parking lot construction, retaining walls and/or <br /> paving.Consult with City of Everett Permit Service for the appropriate type of permit and its <br /> required documents. <br /> The dumping of oil down into the vegetation leading to the rear lot area,the storage of vehicle fluids <br /> without meeting secondary containment and cover requirements, and the presence of vehicle <br /> maintenance activity without meeting secondary containment and cover requirements, are violations of <br /> Everett Municipal Code (EMC)14.28.140& 14.28.130,which read: <br /> • EMC 14.28.140 Illicit discharges and connections. <br /> A. Prohibited Discharges. No person shall throw, drain, or otherwise discharge, cause or allow <br /> others under its control to throw, drain or otherwise discharge into the storm drainage system <br /> or any receiving waters any materials other than stormwater. Illicit discharges are prohibited <br /> and constitute a violation of this chapter. Examples of prohibited materials include, but are not <br /> limited to,the following: <br /> 1. Trash or debris. <br /> *** <br /> 3. Petroleum products including but not limited to oil,gasoline, grease,fuel oil and heating oil. <br /> 4. Antifreeze and other automotive products. <br /> 5. Metals in either particulate or dissolved form. <br /> *** <br /> 28. Chemicals not normally found in uncontaminated water. <br /> 30. Any hazardous material or waste not listed above. <br /> *** <br /> Notice and Order Page 3 of 8 <br />
