D. Approval of the Alteration or Vacation <br /> 1. Approval of the alteration or vacation shall constitute authorization for the <br /> applicant to develop the alteration or vacation facilities and improvements as <br /> required in the approved preliminary approval. Development shall be in <br /> accordance with the plans and specifications as approved by the City subject to <br /> all conditions and requirements of the preliminary approval. <br /> 2. Time Limits for Preliminary Approval_ <br /> A preliminary alteration or vacation decision shall be issued by the Director and <br /> City Engineer or Hearing Examiner within one hundred twenty (120) days as <br /> defined in Ordinance No. 2136-96, as amended. <br /> 3. Expiration of Preliminary Subdivision Alteration or Vacation Approval: <br /> Final subdivision alteration or vacation approval must be obtained within five <br /> (5) years of preliminary subdivision alteration or vacation approval, after which <br /> time the preliminary approval will be void. An extension may be granted by the <br /> City for one (1) year if the applicant has attempted in good faith to submit the <br /> final plat alteration or vacation within the five (5) year time period; provided, <br /> however, the applicant must file a written request with the Director requesting <br /> the extension at least thirty (30) days before expiration of the five (5) year <br /> period. <br /> 4. Expiration of Preliminary Short Subdivision Alteration or Vacation <br /> Approval: <br /> Final short subdivision alteration or vacation approval must be obtained within <br /> three (3) years of preliminary short subdivision alteration or vacation approval, <br /> after which time the preliminary short subdivision alteration or vacation <br /> approval will be void. No extension may be granted by the City to the <br /> applicant. <br /> E. Final Application Submittal Requirements <br /> To submit for final alteration or vacation, the applicant shall have prepared all <br /> documents and maps, and performed all surveys as deemed necessary by the City in <br /> accordance with Section 2.G of this Ordinance. <br /> F. Final Review and Approval Process <br /> 1. Required Review Process: <br /> a) The applicant must demonstrate compliance with all the conditions and <br /> requirements of the preliminary approval and all of the necessary final <br /> documents as required in Section 3.E of this Ordinance. <br /> b) A final alteration or vacation shall be reviewed using the same review <br /> process used for final subdivisions as defined in Section 2.H of this <br /> Ordinance. <br /> 27 <br />
