Section 2: Section 3 D of Ordinance No. 2136-96 which reads as follows: <br /> D. Review Process III <br /> Review Process III applies to all permit applications that require an open public hearing before <br /> the Land Use Hearing Examiner. <br /> Review Process III actions include the following Hearing Examiner decisions: <br /> 1. Preliminary Subdivision Approvals <br /> 2. Special Property Use Permits <br /> 3. Shoreline Permits (1 acre or larger) <br /> 4. Appeals of Review Process I and II Decisions <br /> 5. Expansion of a Nonconforming Use <br /> 6. Conditional Use Permits <br /> 7. Variances, in conjunction with any decisions for Review Process III permit <br /> applications <br /> 8. All other review processes listed in the Zoning Code as Review Process IIIB <br /> Review Process IIIB actions include rezones and PRD's that are consistent with the <br /> Comprehensive Plan. The Hearing Examiner action shall constitute a recommendation to City <br /> Council. <br /> be and the same is hereby amended to read as follows: <br /> D. Subdivision or Short Subdivision Variance of more than 25% <br /> 6. Binding Site Plan Variances of more than 25% <br /> 7. Special Property Use Permits <br /> 8.
