1 <br /> findings of the Hearing Examiner, the property owner is required to abate all violations including: <br /> either properly storing in an enclosed area or removing and properly disposing of all discarded <br /> items (to be located no further north than the north wall of the house), maintaining the subject <br /> property free of nuisances including discarded junk, rubbish, and construction debris, removing a <br /> wooden shed from the critical area, submitting a land use application and restoration plan to the <br /> City of Everett Planning and Public Works Departments, restoring any impacted wetland and 1 <br /> buffer areas as required by the approved restoration plan, and recording a critical area protective <br /> covenant with the Snohomish County Auditor's office. <br /> The intent of this document is to describe impacts to the subject wetland and buffer and to provide <br /> a restoration plan that will restore critical area and buffer functions and values on the site. <br /> 1.1 SITE DESCRIPTION <br /> Access to the site is from the east via Florida Drive, a private road that is partially located on site. <br /> The site is developed with a single family home in the northern portion of the property. <br /> Surrounding land use is comprised of high density,single-family residences,multifamily residential, <br /> and commercial development. The property is relatively flat,with a gentle slope to the north. <br /> Vegetation on the property consists of maintained lawn, gardens, and ornamental landscaping <br /> plants surrounding the home. Vegetation in the western portion of the site is forested and includes <br /> black cottonwood (Populus balsamifera), Pacific willow (Salix lasiandra), western hemlock (Tsuga <br /> heterophylla), English holly (Ilex aquifolium), creeping buttercup (Ranunculus repens), swordfern <br /> (Polystichum munitum), Douglas' spirea (Spiraea douglasi2), slough sedge (Carex obnupta), and (Phalaris <br /> arundinacea). Soils underlying the site are mapped as Terric Medisaprists, nearly level, and <br /> Alderwood-Urban land complex, 2 to 8 percent slopes. Soils observed in the wetland are <br /> characteristic of areas that are inundated or saturated for extended periods of time. ' <br /> A wetland(Wetland A)is located along the western fringe of the property, extending off-site to the <br /> west. When the house was approved for construction in 2004, the wetland was identified as a <br /> Category II wetland that received a 75-foot buffer. The entire lot was encumbered by the wetland <br /> and buffer, so construction of the house was approved under a reasonable use exception. <br /> Encroachment into the buffer was approved as a reasonable use of the lot. Approximately 10 feet <br /> of buffer was provided between the wetland and the developed area in roughly the northern third <br /> of the lot. Buffer enhancement and fencing were required as part of the approval. <br /> Under the current version of Everett Municipal Code(EMC),Wetland A is classified as a Category <br /> II wetland and receives a 150-foot buffer (EMC 19.37.110).
