<br />D D 5 D i k e R e p a i r D e s i g n – P e r m i t t i n g C o m m e n t R e s p o n s e S u p p o r t <br /> 1 <br />O:\PROJECT\32700\32758\Contract\Amendment No 4_32758C.00\SCOPE_Amend 4_Draft_2024_0115.docx otak <br />SCOPE OF WORK <br />DESIGN/ENGINEERING SERVICES <br />City of Everett <br />DD5 Dike Repair Design <br />OTAK Project No. 32758.C00 <br />January 2024 <br /> <br />Amendment No. 4 <br /> <br />Introduction <br />The City of Everett (City) is anticipating receipt of comments from permitting agencies related to <br />the DD5 Dike Repair Design project (Project). This scope provides engineering support for <br />response to agency comments from City of Everett Shoreline Conditional Use (CUP), United <br />States Army Corps of Engineers (USACE) Section 404 and Section 10 permit, Washington State <br />Department of Ecology (WDOE) 401 Water quality Certification and Shoreline Permit, <br />Endangered Species Act (ESA) Section 7 Consultation from NOAA Fisheries and the United <br />States Fish and Wildlife Services (USFWS) and the Washington Department of Fish and Wildlife <br />(WDFW) Hydraulic Project Approval (HPA) (Agencies – USACE, City of Everett, WDOE, and <br />WDFW). (Services – NOAA Fisheries and USFWS). Otak completed the engineering design for <br />the Project in April, 2022. Otak performed initial comment review for Department of Ecology <br />comments in March 2023.The City has now requested that Otak provide support to the City in <br />responding to Agencies comments related to design of the proposed dike repair improvements. <br /> <br />Otak will review comments and related design documents, prepare responses supported by <br />exhibits, and attend review meetings with the Agencies. <br /> <br />Scope Assumptions <br />1. The City will lead all correspondence and comment responses with Agencies; Otak will <br />provide technical support related to engineering design completed in April, 2022. <br />2. The Level-of-Effort estimate provided to the City is an estimate of hours for comment <br />response, however, the number and nature of comments that will be received are <br />unknown. The response services will be provided on an as-requested basis and the <br />scope and level-of-effort will be reviewed with the City when comments are received and <br />a request for review is made. <br />3. The scope will be completed within a six month period from February through July 2024. <br />4. Narrative responses and exhibits demonstrating the elements of the layout related to <br />impacts will be sufficient for Agencies and Services to accept the responses. <br />5. This task scope does not include redesign of the dike repair improvements or revisions to <br />previous design plans, technical reports, or dike stability assessment. If redesign is <br />needed, additional scope and budget will be negotiated. <br />6. Geotechnical services are not included in this task scope. <br />7. Agencies comments related to easements, property acquisition, and mitigation ratios will <br />be answered by the City, or others. <br /> <br />Task 11 - 2023 Ecology Comment Response Support
