FIRE CODE ORDINANCE Page 5 of 38 <br />EXHIBIT A <br />TO FIRE CODE ORDINANCE <br />CHAPTER 16.03 EMC <br />AMENDMENTS TO THE INTERNATIONAL FIRE CODE <br />16.03.010 Amendments to International Fire Code (hereinafter referred to as the “IFC”) Chapter 1, <br />Scope and Administration. <br />Adopted as amended by Washington State with the following local amendments: <br />A.Subsection 101.1. of the IFC, entitled “Title,” is hereby deleted and the following inserted in its <br />place: <br />101.1 Title. These regulations shall be known as the Fire Code of the City of Everett, hereinafter <br />referred to as “this code.” <br />B.Subsection 103.1. of the IFC, entitled “Creation of agency,” is hereby deleted and the following <br />inserted in its place: <br />103.1 Creation of agency. The Fire Marshal’s Office is hereby crested and the official in charge <br />thereof shall be known as the fire code official and/or Fire Marshal. The function of the agency shall <br />be the implementation, administration and enforcement of the provisions of this code. <br />C.Subsection 104.1.1. of the IFC, entitled “Authority of peace officers,” is hereby added: <br />104.1.1. Authority of peace officer. The fire code official and his/her designee(s) shall be <br />empowered to exercise the authority of a peace officer to the extent necessary to enforce the <br />Everett fire code, which power shall include but not be limited to issuances of citations. No person <br />shall commit the offense of obstructing or threatening a fire code official while such official is <br />performing his or her official duties. <br />D.Subsection 104.3.2. of the IFC, entitled “Fire and Life Safety Inspection,” is hereby added: <br />104.3.2 Fire and Life Safety Inspection. To enforce the provision of this code the fire code official <br />shall manage and ensure that routine Fire and Life Safety Inspection are conducted on all applicable <br />buildings and/or occupancies of this code. The frequency of Fire and Life Safety Inspections are <br />subject to staffing levels and hazard priorities. <br />E.Subsection 104.11. of the IFC, entitled “Fire Investigations,” the following language is hereby <br />deleted: <br />Information that could be related to trade secrets or processes shall not be made part of the public <br />record, except as directed by a court of law.
